Overtime Status Clause Samples

The Overtime Status clause defines whether an employee is eligible to receive overtime pay for hours worked beyond the standard workweek. Typically, this clause specifies if a position is classified as "exempt" or "non-exempt" under applicable labor laws, such as the Fair Labor Standards Act (FLSA), and outlines the criteria used for this determination. By clearly stating overtime eligibility, the clause helps both employers and employees understand compensation expectations and ensures compliance with wage and hour regulations.
