(vii) No payment or concession to the Supplier by the Customer or other act or omission of the Customer shall in any way affect the rights of the Customer to recover the Delay Payments pursuant to the provisions of this paragraph 5.1 of this Order or be deemed to be a waiver of the right of the Customer to recover any such damages unless such waiver has been signed by the Customer, expressly made in writing by the Customer and refers specifically to a waiver of the Customer’s rights to claim Delay Payments. (viii) At the Commencement Date, the Supplier and the Customer agree that the daily Delay Payments sum specified in paragraph (i) represents a genuine pre-estimate of the Customer’s loss.
