Period of Continuous Service Redundancy Pay Sample Clauses

The 'Period of Continuous Service Redundancy Pay' clause defines how an employee's length of uninterrupted service with an employer is calculated for the purpose of determining redundancy pay entitlements. Typically, this clause outlines what counts as continuous service, such as including certain types of leave or excluding breaks in employment, and specifies how the total period is measured. By clearly establishing the rules for calculating service duration, this clause ensures that redundancy payments are allocated fairly and consistently, preventing disputes over eligibility and payment amounts.

Where an employee has worked irregular hours, the average hours worked in the 3 months prior to termination will be used to calculate any redundancy payments payable under this clause. The redundancy payments must not exceed the amount which the employee would have earned if employment with Travellers Aid had proceeded to the employee's normal retirement date. If Travellers Aid is able to obtain an offer of suitable alternative employment for an employee there will be no obligation to pay redundancy under this Agreement, even if the employee does not accept the offer. The redundancy payment in this clause is not payable in circumstances where, due to a restructure or transmission of business, an employee's position is made redundant, but Travellers Aid is able to procure an offer of employment for the employee, on similar terms and conditions. A reduction in rostered hours or change in location, will not be sufficient to entitle an employee to redundancy payments if the other terms remain similar to those previously received by the employee. Should Travellers Aid have less than 15 employees (including casual employee) at the time employees are made redundant, then no redundancy will be payable under this term.
