PERSONNEL ASSIGNMENTS. (a) The Contractor shall perform the Services in an orderly and workmanlike manner, and shall utilize persons skilled and qualified for the performance of the Services. The Authority will have the right to review the experience of each person assigned to perform the Services and approve personnel assignments, including those to be performed by Subcontractors, (b) The Contractor certifies that the Contractor, and each Subcontractor, have established a criminal history back- ground policy that complies with guidance issued by the U.S. Equal Employment Opportunity Commission and that the Contractor and each Subcontractor conducts criminal history checks on its assigned personnel in accordance with such policy to identify, hire and assign personnel to work on this Contract whose criminal backgrounds are appropriate for the Services being performed, considering the risk and liability to the Contractor and the Authority. The Authority reserves the right to require the Contractor and any Subcontractor to disclose any criminal or military criminal convictions of assigned personnel and the right to disapprove the use of assigned personnel with criminal or military convictions. (c) At the commencement of the Contract, the Contractor shall provide a list of candidates to be used to provide the Services and shall certify that a criminal history background check has been completed on each candidate within the preceding 6-month period Thereafter during the Term, the Contractor shall submit quarterly report containing a list of all persons (including Subcontractors) assigned to perform Services under the Contract and a certification that each named person has undergone a criminal background check as required by this Contract. The Authority shall have the right to audit the Contractor’s records for compliance with the provisions of this Section. Criminal back- ground checks shall include the following:
PERSONNEL ASSIGNMENTS. A. The College Chief Academic Officer will be responsible for approving faculty to teach dual enrollment courses. The high school is responsible for providing the College Chief Academic Officer with the graduate transcripts of a resident faculty member that it desires to put forward as a possible teacher of NFCC courses. B. The faculty assigned to teach dual enrollment courses will meet SACS criteria. The College will collaborate with the School Board in making faculty appointments to teach dual enrollment courses at the high school. C. All faculty, including those teaching classes meeting in the high schools, will be paid by the College unless alternate arrangements are agreed upon by the School Board and the College. D. There will be an orientation for instructors assigned to teach dual enrollment courses. This will be part of the College preplanning activities and will be directed by the Director of Curriculum and Instruction. E. The purpose of the orientation session will be to share important information and instructional materials that will support and enhance teaching effectiveness. Instructional effectiveness throughout the district remains a high priority for the College.

The Authority will have the right to review the experience of each person assigned to perform the Services and approve personnel assignments, including those to be performed by Subcontractors, (b) The Contractor certifies that all full-time, part-time, temporary or seasonal employees of Contractor and Con- tractor’s Subcontractor who are assigned to provide non-construction services to Capital Metro under this Contract (“Directly Assigned Employees”) must be paid a “Living Wage” for providing such services. “Living Wage” as used in this Section has the meaning set forth in the City of Austin’s Rule R161-17.14: Enforcement of the City of Austin’s Living Wage for Non-Construction Contracts Effective June 5, 2017, as amended from time to time. As the Living Wage amount may change from time to time, the Living Wage amount applicable at the time of Contract award will remain the same throughout the term of the Contract, including extension options. At the commencement of the Contract, the Contractor shall provide to Capital Metro a list of Directly Assigned Employees and shall certify in writing that such Directly Assigned Employees will be paid the Living Wage throughout the Term of the Contract. Thereafter during the Term, the Contractor shall submit quarterly report containing a current list of all Directly Assigned Employ- ees and a certification that each Directly Assigned Employee is paid the Living Wage for providing non-construction services in connection with the Contract. The Authority shall have the right to audit the Contractor’s records for com- pliance with the provisions of this Section.

PERSONNEL ASSIGNMENTS i. Contractor or its subcontractor(s) shall assign all key personnel identified in this Agreement to perform work under this Agreement (“Key Personnel”). Key Personnel shall perform work under this Agreement, unless otherwise approved in writing by the SVP or their authorized representative. In the event that replacement of Key Personnel is necessary, the City in its sole discretion shall approve or reject the replacement, if any, or shall determine that no replacement is necessary. ii. It is the intent of the Parties that all Key Personnel perform their specialty for all such services required by this Agreement. Contractor and its subcontractor(s) shall retain Key Personnel for the entire Term of this Agreement to the extent practicable and to the extent that such services maximize the quality of work performed. iii. If, during the Term of this Agreement, the Project Manager determines that the performance of any Key Personnel or other personnel, whether of Contractor or its subcontractor(s), is not acceptable or that any such personnel is no longer needed for performance of any work under this Agreement, the Project Manager shall notify Contractor and may give Contractor notice of the period of time which the Project Manager considers reasonable to correct such performance or remove the personnel, as applicable. iv. If Contractor fails to correct such performance, then the City may revoke its approval of the Key Personnel or other personnel in question and notify Contractor that such Key Personnel or other personnel will not be retained on this Project. Within ten (10) days of receiving this notice, Contractor shall use its best efforts to obtain adequate substitute personnel who must be approved in writing by the Project Manager. Contractor’s failure to obtain the Project Manager’s approval shall be grounds for Termination for Cause in accordance with this Agreement.

Immediately following the conclusion of each interview process, the RCSI and First Data participants will review the identified system differences and begin to identify possible solutions. During the term of this Agreement, the ACSO shall place one (1) SRO at Eagle High School, one (1) SRO at Eagle Middle School, one (1) SRO at Star Middle School, one (1) SRO at ▇▇▇▇ ▇▇▇▇▇ Middle School, and one-half (.5) SRO at Eagle Academy. b. When it becomes necessary to select a new or replacement SRO, ACSO policies governing such procedures shall apply; provided, however, the District shall have the opportunity to provide constructive input into the selection of the SRO.

Notwithstanding the above, in the event of an emergency and Department call- back of off-duty bargaining unit personnel, such apparatus may respond to an existing emergency scene already manned with bargaining unit personnel with only one (1) call-back bargaining unit member along with one (1) or more volunteer fire fighters with a minimum Connecticut State Fire Fighter 1 Certification.
PERSONNEL ASSIGNMENTS. July 4 - The City agrees that two (2) weeks in advance of July 4th it will post, on the official bulletin boards, a list of those scheduled to work on July 4th. In order to facilitate the department meeting its two (2) weeks in advance posting requirement, the shift sign-up list will be posted for a period of two (2) weeks starting on or about June 1. Employees are expected to complete the shift sign-up list as soon as possible after it has been posted.
