Position Availability. If the employee is certified as able to return to work from a disability leave by an acceptable medical authority within the 180 calendar day period, the employee will be returned to the position he/she previously occupied. A written request to hold a position beyond 180 working days will be considered by the University and will be granted if the O.U. Police Department determines that the Department can function adequately for this extended period of time without filling the position. In no event will a position be held for an employee for longer than a total of one (1) year.
Position Availability. No new teacher shall be employed by the School District while any qualified teacher is on unrequested leave of absence in the subject matter category in positions covered by this Agreement. Teachers placed on unrequested leave of absence shall be reinstated to the position from which they have been given leave, or any other available position in the School District covered by this Agreement in the subject matter categories in which they are licensed. The order of reinstatement shall be in inverse order in which teachers were placed on unrequested leave.
Position Availability. When a position becomes available and the board has acted on it, the building principals will send an email to all staff notifying them of the position. He/she would have an opportunity to apply for the position. Current staff who wish to be considered and are qualified to fill the position, must submit a written request within (5) five calendar days of notification to the appropriate principal or superintendent. The available position will be advertised in the paper, Teacher Placement and on the school website.
Position Availability. The employee may elect to remain in the same reduced position in the 6 event that the position is still available; or
Position Availability. A disabled employee who is unable to be certified by his physician to return to work as an Operator will be provided all vacancy announcements for a period of twelve (12) months after termination if injured off-the-job and for the time frame provided in Article 14, Section 6, for an employee with an on-the-job injury, unless the employee requests in writing that such notifications cease.

  • High Availability Registry Operator will conduct its operations using network and geographically diverse, redundant servers (including network-­‐level redundancy, end-­‐node level redundancy and the implementation of a load balancing scheme where applicable) to ensure continued operation in the case of technical failure (widespread or local), or an extraordinary occurrence or circumstance beyond the control of the Registry Operator. Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.

  • Minimum Availability Borrower shall have minimum availability immediately following the initial funding in the amount set forth on the Schedule.

  • Product Availability Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.
