The 'Available position' clause defines what constitutes an open or vacant role within an organization that may be offered to an employee, often in the context of redeployment or reassignment. Typically, this clause outlines the criteria for a position to be considered available, such as being unfilled, suitable for the employee’s qualifications, and not already promised to another candidate. Its core function is to provide clarity and fairness in the process of offering alternative employment opportunities, especially during restructuring or redundancy situations.
Available position. A full-time teaching load assigned and spread over two (2) semesters: a) created following the distribution provided for in article 8-5.00 or, subsequently, following fluctuations in course or program enrolment, as the case may be; or b) left permanently vacant by the departure of the incumbent. For any given teaching year, no available position may be created after October 1.
Available position. A position that has no incumbent and the Employer deems should be filled.
Available position. 1. For the purpose of applying this article, a full-time position or part-time position is considered to be available when no applicant has applied or when none of the employees who applied meet the normal requirements of the job, or when the position should be granted, under the provisions on voluntary transfers, to an applicant who holds a part-time position and who has less seniority than the employee registered with the SNMO who has the most seniority. 2. No institution may resort to an employee who holds a part-time position and who has less seniority than the employee registered with the SNMO who has the most seniority or hire an outside applicant for an available position as long as there are employees covered by clause 15.03, and registered with the SNMO, who meet the normal requirements of the job for such a position.
Available position. A full-time annual assignable teaching load: a) created following the assignment of one (1) full-time equivalent (FTE) professor to one subject as provided for in article 8-4.00, or subsequently, following an increase in the official course or program enrolment as the case may be; or b) left permanently vacant by the departure of the incumbent. For any given teaching year, no available position may be created after September 30.

B) No institution may call in a part-time employee with less seniority than an employee covered by clause 15.03 who is registered on the SNMO list, or hire an outside applicant for an available full- time or part-time position as long as there are employees covered by clause 15.03 who are registered on the SNMO list and meet the normal requirements of such a position.
Available position. The Union shall notify the Employer of the employee’s intent within one (1) week.

At the Union’s request, the Employer informs the Union of the reason why the position is not temporarily filled. 4. The Employer cannot appoint an employee to an available position as long as the institution is waiting for an employee referred by the SNMO. The latter has ninety (90) days to refer an employee.

  • Term Position A position occupied by a full-time or part-time nurse for a specified period of time, up to a maximum of sixty (60) weeks, where patient/client/resident census or workload necessitates a temporary increase in staffing, if mutually agreed, to replace a nurse(s) who is/are on vacation or leave of absence, or to carry out a special short term project or where the Employer has provided notice of permanent deletion of position(s) under the Memorandum of Understanding regarding Employment Security, or as otherwise mutually agreed between the Union and the Employer. If the Employer determines there is a term position to be filled by a nurse, the term position shall be posted in accordance with Article 30. This shall not preclude the Employer from utilizing part-time nurses and/or casual nurses to work available shifts as specified in Articles 34 and 35 when the Employer decides that a term position is not required. The Employer shall provide written confirmation of the start and expiry dates of the term position prior to the nurse's commencement in the position. This period may be extended if the Employer so requests and the Union agrees. The maximum duration specified in paragraph 1 above for term positions shall not apply in situations where a nurse is absent indefinitely due to Workers Compensation and/or illness and/or accident or where there is a temporary vacancy due to leave for Public Office. In these cases, the Employer shall state on the job posting that the said term position is an "Indefinite Term" which will expire subject to a minimum of twenty-four

  • New Positions The Board, in consultation with the Association, shall prepare a new job description whenever a new position of special responsibility is created or whenever the duties of any such position are changed or increased. When such a position is created or changed, the allowance shall be subject to negotiations between the Board and the Association.

  • Call-Out Pay An employee who has already left the premises of the Company after completion of his scheduled shift, and who is recalled for work, shall be paid double his regular straight time hourly rate for all hours worked on recall up to the starting time of his scheduled shift but, in any event, he shall be paid for not less than two (2) hours at double his regular straight time hourly rate.
