Common use of Position Outside the Bargaining Unit Clause in Contracts

Position Outside the Bargaining Unit. Any nurse presently in the bargaining unit who elects to transfer to a position outside the bargaining unit, but remains in the employ of SJHC, may be rehired into the bargaining unit after the Employer has complied with the job posting and recall provisions. In the event that a nurse is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she will lose all seniority held at the time of transfer. In the event that the nurse is returned to a position in the bargaining unit, the nurse’s seniority will accrue from the date of her return to the bargaining unit.
