Provider Capacity Clause Samples
The Provider Capacity clause defines the requirement that the service provider possesses the necessary resources, skills, and legal authority to fulfill its contractual obligations. In practice, this clause ensures that the provider has adequate personnel, equipment, and any required licenses or permits to deliver the agreed-upon services. Its core function is to assure the client that the provider is fully capable of performing as promised, thereby reducing the risk of non-performance or legal complications.

The State will provide monitoring, oversight, and technical assistance to ensure supported employment providers use evidence-based employment practices, have adequate staffing, organizational support and supervision, and use effective business models to meet the goals and outcomes of this Consent Decree. The State will develop and publicize its oversight process and provide mechanisms for individuals with I/DD, their families, service providers, and advocates to file complaints which will be timely addressed by the State.
