PUBLIC SECURITY Clause Samples

The PUBLIC SECURITY clause establishes the parties' obligations and rights in situations where public safety or security concerns arise. Typically, this clause allows for the suspension or modification of contractual duties if compliance would endanger public welfare, such as during riots, terrorist threats, or government-imposed security measures. Its core function is to provide flexibility and legal protection for parties when unforeseen public security issues make normal contract performance unsafe or impossible.
PUBLIC SECURITY. 3.1: The Union recognizes that strikes or work stoppages are illegal and contrary to public policy in Michigan and that strikes or work stoppages are detrimental to the public safety and welfare. The Union, therefore, agrees that there shall be no interruption of the services performed by employees covered by this Agreement for any cause, whatsoever, nor shall they absent themselves from their work, stop work or abstain in whole or in part from the full, faithful and proper performance of the duties of their employment, or picket the City’s premises while on- duty. The Union further agrees that there shall be no strikes, sit-downs, stay-ins, stoppages of work or any acts that interfere in any manner or to any degree with the services of the City. The occurrence of any such acts or actions prohibited in this section by the Union shall be deemed a violation of this Agreement. Any employee who commits any of the acts prohibited in this section shall be subject to discharge or other disciplinary action as may be determined by the City.
PUBLIC SECURITY. The Authority is responsible for the safety and security of large numbers of people at any given time. Any and all staff of Contractors who shall be visiting the facilities of the Authority pursuant to the on-site services of the scope of work herein or for any other reason, are subject to security checks before entering the facilities. In special circumstances and as the Authority deems necessary, the Authority may also require, and the Contractor shall provide, badging of the Contractor’s staff per Authority instructions, deviation of normal route for entry to the facilities, additional sign- in procedures, and delay or postponement of services at the Authority’s request. Other special procedures may be required in which case the Authority and Contractor may mutually amend this Agreement to allow for such consideration.
PUBLIC SECURITY. 5.1 It is understood between the parties that the services to be performed by the employees covered by this Agreement pertain to and are essential to the operation of a public utility, and to the health, safety, and welfare of the public. 5.2 The Union agrees that it will not call upon or authorize employees to cease or abstain from the continuous performance of their respective duties with the Company in accordance with the provisions of this Agreement. 5.2.1 During the life of this Agreement, the Union will not cause a strike, nor will any employee or employees take part in a strike, sympathy strike, intentional slowdown in rate of work, or any other interference or stoppage of the Company’s work. 5.2.2 Should a contingency arise where an employee or employees covered by this Agreement cease or abstain from their duties with the Company, the Company shall take the necessary steps to discipline properly such employee or employees. 5.3 The Company agrees that it will not do anything to prevent such continuity of performance of said employees insofar as such services are required in the normal and usual operation of the Company's properties.
PUBLIC SECURITY. Section 1. The parties to this Agreement mutually recognize that the services performed by employees covered by this Agreement are essential to public health, safety, and welfare. The Union, therefore, agrees that there shall be no interruption of these services for any cause whatsoever by the employees it represents, nor shall there be any concerted failure by them to report for duty, nor shall they absent themselves from their work, stop work, abstain in whole or in part from their full, faithful, and proper performance of the duties of their employment. The Union further agrees that there shall be no strike, sit-downs, stay-ins, stoppages of work, or acts that interfere in any manner or to any degree with the services of the County. Section 2. An employee involved in any of the above-stated activities may be subject to discipline at the discretion of the Sheriff.
PUBLIC SECURITY. For events with a large number in an attendance (more than 100), the Client must hire private security to ensure public safety during the course of the event. At least one security officer must be hired for the first 150 people, and one additional security officer for every fifty (50) people thereafter, at the Client’s expense (e.g. 151 attendees requires two security officer personnel to supervise the event). Security personnel must be licensed and certified by the Oregon Department of Public Safety and Standards Training and must be working (not just attending) the event. The Client at their option may choose to employ additional security personnel at their own expense.

The Union and the Company have negotiated a no strike, no lockout agreement. The IBEW Local 702 agrees that no employees will participate in any work stoppage or slowdown and the Company agrees it will not implement a lockout. 24.2 Should a contingency arise where an employee or employees covered by this Agreement cease or abstain from his or their duties with the Company, without the authority and not as the result of the call of the Union, then, at the request of the Company the parties shall cooperate to enable the Company to carry on its operations without interruption or other injurious effects, and each of the parties hereto shall take the necessary steps to discipline properly such employee or employees.
PUBLIC SECURITY. The Union, its officers, agents, members and employees covered by this Agreement agree as long as this Agreement is in effect that there shall be no strikes, sit-down stoppages of work, boycotts or other unlawful acts that interfere with the Employer's operations and they will take affirmative action to prevent and stop any that occur in disregard of the commitment.
PUBLIC SECURITY. 4.1: The Union recognizes that strikes or work stoppages are illegal and contrary to public policy in Michigan and that strikes or work stoppages are detrimental to the public safety and welfare. The Union therefore agrees that there shall be no interruption of the services performed by employees covered by this agreement for any cause whatsoever, including strikes or job actions taken in sympathy for the actions of another labor union, nor shall they absent themselves from their work, stop work or abstain in whole or in part from the full, faithful and proper performance of the duties of their employment, or picket the City's premises while on duty.
Unless otherwise agreed in the special contract terms, the employer shall consult with the local public security department to establish a public security management agency or joint defense organization on site to uniformly manage public security matters at the construction site and perform public security duties for the contract project. In addition to assisting the on-site security management agency or joint defense organization in maintaining social order at the construction site, the employer and the contractor should also do a good job in public security protection in their respective jurisdictions, including living areas. Unless otherwise agreed in the special contract terms, the employer and the contractor shall jointly prepare a construction site security management plan within 7 days after the commencement of the project, and formulate an emergency plan to deal with sudden public security incidents. During the construction process, if there are terrorist incidents such as riots and explosions, as well as group sudden public security incidents such as group fights and armed fights, the employer and the contractor shall immediately report to the local government. The employer and the contractor shall actively assist the local relevant departments in taking measures to calm the situation, prevent the situation from escalating, and try to avoid casualties and property losses.
