Pursuant to Education Code. 87775, the District and Board of Trustees shall be freed from any liability for payment of any compensation or damages provided by law for the death or injury of any faculty member when the death or injury occurs while the faculty member is on any leave of absence granted pursuant to this Article.
Pursuant to Education Code section 44977.5, a full-time certificated unit member shall be granted a maximum of 12-working weeks of Paid Parental Leave. A part-time certificated unit member shall be granted a prorated share of the 12-working weeks of Paid Parental Leave.
Pursuant to Education Code. Section 87743, the services of no regular employee shall be terminated while any probationary employee, or any other employee with less seniority, is retained to render a service in an FSA for which that regular employee meets eligibility Criteria A or B in Article 20.5.
Pursuant to Education Code section 44977, when a unit member, because of illness or accident, has used all regular and accumulated sick leave, he/she is then placed on statutory sick leave for a period of not more than five (5) school months (100 working days) in any fiscal year. Illness leave is limited to five (5) school months (100 days) of illness leave for each illness. During this period, a unit member shall be paid either fifty percent (50%) of his/her contracted salary rate or substitute differential pay, whichever is greater. In determining substitute differential pay, the amount deducted from the salary due the unit member in any month in which the absence occurs shall not exceed the amount actually paid the substitute employee employed to fill his/her position or, if no substitute is employed, the amount which would have been paid to the substitute had one been employed.
Pursuant to Education Code. Section 88013, a permanent employee who accepts a promotion and fails to complete the probationary period for that promotional classification, shall be employed in the position from which he or she was promoted.
Pursuant to Education Code. Section 45196.1, in order to qualify for child bonding leave, unit members must have completed one year (twelve months of service) for the District, but are not required to have at least 1,250 hours of service during the previous one year (twelve months) period.
Pursuant to Education Code. Section 87766, the District shall provide for leave of absence from duty for any academic employee of the district who is required to be absent from duties because of pregnancy, miscarriage, childbirth, and recovery there from. The length of the leave of absence, including the date on which the leave shall commence and the date on which the employee shall resume duties, shall be determined by the employee and the employee’s physician. 11.3.1.1 An employee shall report her condition to her supervisor and indicate her plans if she intends to request a leave of absence other than that of temporary disability due to pregnancy, miscarriage, childbirth, or recovery there from. Such notification shall occur within a reasonable period of time prior to the employee’s first date of leave so that substitute services may be arranged, and the educational program suffers the least interruption.
Pursuant to Education Code. 44502(a), the Joint Committee shall: a. Select Consulting Teachers. b. Review peer review reports prepared by Consulting Teachers. c. Make recommendations to the Board of Trustees regarding PAR program participants, including informing the Board of the names of participants who the Joint Committee determines have not demonstrated “satisfactory improvement” after receiving “sustained assistance” from a Consulting Teacher. All recommendations pursuant to this provision shall be made to the Board not later than 30 days after the receipt of the final report from a Consulting Teacher. d. Make an annual evaluation of the impact of the PAR program “in order to improve the program.” The program evaluation shall be presented to the Board of Trustees at the regular June meeting. e. In addition, the Joint Committee has the discretion to submitrecommendations for improvement of the program.” Recommendations for improvement are submitted to the Board of Trustees and to the Exclusive Representative.

  • Special Education Special education services, related services, and accommodations for students who are eligible under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973 (Section 504), the Americans with Disabilities Act (ADA), or any applicable provisions of state law, shall be provided in accordance with applicable state and federal law, this Agreement and Authorizer rules and policies. The Authorizer is the LEA for purposes of ensuring compliance with IDEA, Section 504, and all other federal and state laws and regulations concerning accommodation of and education of students with disabilities.
