Pursuit of Certain Claims. I agree that other than to enforce this Release, I will never (i) take any legal or other action to initiate, pursue, maintain, or otherwise attempt to execute upon, collect, or otherwise enforce, any of the Released Claims and Liabilities of or against any Released Party;

Pursuit of Certain Claims. Other than to participate in the Settlement , I agree that from and after the date on which this Release is executed until the earlier of either (i) the date on which my Dismissal With Prejudice Stipulation is delivered to Defendants or (ii) I exit the settlement program and this Release is returned to me, I shall be prohibited from, and refrain from, taking any action (including any legal action) to initiate, pursue, maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any actual or alleged Released Claims and Liabilities of or against Defendants or any other Released Party. I will also cooperate in all reasonable respects with Defendants to seek to stay, and to continue in effect any then outstanding stay with respect to, any pending legal proceedings instituted by me and/or Derivative Claimants against any Released Party in connection with Released Claims, and I will refrain from instituting any new legal action against any Released Party in connection with any Released Claim. I will also be prohibited from and refrain from, attempting to execute or collect on, or otherwise enforce, any judgment that may be entered against any Released Party in connection with any Released Claim. I also agree that if I am determined or deemed to be a Registered Claimant, or if I exit the settlement program under circumstances such that my Release remains in effect, in furtherance and not in limitation of such Release, any judgment in connection with any Released Claim automatically shall be deemed to have been Released by me and all such Derivative Claimants. I agree that I and any Derivative Claimants shall execute such instruments, and take such other actions, as Defendants reasonably may request in order to further evidence or implement the same.

Pursuit of Certain Claims. Chicago agrees that it will never (i) take any legal or other action to initiate, pursue or maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any of the Released Claims and Liabilities of or against any Released Party; (ii) institute or participate in any new legal action (excluding criminal prosecutions) against any Released Party to any extent, or in any way, arising out of, relating to, resulting from and/or connected with ▇▇▇▇ Products and/or with any injury or violation Chicago (and/or any other Releasing Party) has ever claimed, or may at any time hereafter claim, ▇▇▇▇ Products caused in whole or in part; or (iii) attempt to execute or collect on, or otherwise enforce, any judgment that may be entered against any Released Party in any legal action described in clause (ii) or its pending legal action against JLI.

Pursuit of Certain Claims. 7.2.1 From and after the date on which an Enrollment and Claims Form is submitted in relation to a particular Eligible Claimant until the earlier of (i) the date on which such Eligible Claimant’s Release(s) and Stipulation of Dismissal, if any, is delivered to Bayer pursuant hereto or (ii) if applicable, the date such Enrollment and Claims Form is finally rejected by the Claims Administrator or Bayer in relation to such Eligible Claimant pursuant to the terms hereof or such Eligible Claimant exits the Program under circumstances such that his Release(s) and Stipulation of Dismissal, if any, is returned to him, such Eligible Claimant shall: 7.2.1.1 Be prohibited from, and refrain from, taking any action (including any legal action) to initiate, pursue or maintain, or otherwise attempt to execute upon, collect or otherwise enforce any actual or alleged Released Claims against Bayer or any other Bayer Released Party (other than to the extent inherent in making and pursuing a Program Claim in accordance with the terms of this Agreement);

Pursuit of Certain Claims. Releasor agrees that it will never (i) take any legal or other action to initiate, pursue or maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any of the Released Claims and Liabilities of or against any Released Party; (ii) institute or participate in any new legal action (excluding criminal prosecutions) against any Released Party to any extent, or in any way, arising out of, relating to, resulting from and/or connected to any of the Released Claims and Liabilities; (iii) attempt to execute or collect on, or otherwise enforce, any judgment that may be entered against any Released Party in any legal action described in clause (ii) or its pending legal action against Altria; or (iv) take any legal or other action against any Released Party concerning the administration, settlement allocation, individual settlement amount, or any other aspect of the Government Entity Settlement Program.

Pursuit of Certain Claims. The Parties agree that to administer the Process, ▇▇▇▇▇▇▇▇▇ must agree to refrain from asserting certain legal claims, stay certain legal claims, and dismiss class action claims. a) From and after the date on which a Claim Form is submitted by a Claimant until the earlier of: (i) the date the Release and Incorporation of Settlement and any Stipulation of Dismissal With Prejudice accompanying such Claim Form is delivered to Monsanto pursuant hereto; (ii) the date the Claimant’s Process Claim is finally rejected by the Claims Administrator and, if appealed, the Appeals Master, or the time to appeal the Claim Administrator’s final rejection has expired; or (iii) such Claimant exits the Process under circumstances such that the Claimant’s Release and Incorporation of Settlement and Stipulation of Dismissal With Prejudice, if any, are destroyed by the Claims Administrator, such Claimant: i) will be prohibited from, and refrain from, taking any action (including any legal action) to initiate, pursue, or maintain, or otherwise attempt to execute upon, collect, or otherwise enforce any actual or alleged Claims against any Monsanto Released Party (other than to the extent inherent in making and pursuing a Process Claim in accordance with the terms of this Agreement); ii) must cooperate in all reasonable respects with Monsanto to seek to stay, and to continue in effect any then outstanding stay with respect to, any pending legal proceedings instituted by such Claimant against any Monsanto Released Party or any Additional Released Party related to the subject matter of this Agreement; iii) must refrain from instituting any new legal action against any Monsanto Released Party related to the subject matter of this Agreement; and iv) will be prohibited from, and refrain from, attempting to execute or collect on, or otherwise enforce, any judgment that may be entered against any Monsanto Released Party or any Additional Released Party in any legal action described in Section 32.a.ii. Further, if a Claimant exits the Process under circumstances such that the Claimant’s Release and Incorporation of Settlement remains in effect, in furtherance and not in limitation of such Release and Incorporation of Settlement, any judgment referred to in Section 32.a.iv automatically will be deemed to have been released by such Claimant, and such Claimant must execute such instruments, and take such other actions, as Monsanto reasonably may request in order to further evidence or impleme...

Pursuit of Certain Claims. Other than to participate in the Settlement, I agree that from and after the date on which this Release is executed until the earlier of either (i) the date on which this Release is delivered to the Philips Defendants, or (ii) I exit the Program and this Release is returned to me, I shall be prohibited from, and refrain from, taking any action (including any legal action) to initiate, pursue, maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any actual or alleged Released Claims against any of the Released Parties. I will also cooperate in all reasonable respects with the Philips Defendants to seek to stay, and to continue in effect any then outstanding stay with respect to, any pending legal proceedings instituted by me and/or Derivative Claimants against any Released Party in connection with Released Claims, and I will refrain from instituting any new legal action against any Released Party in connection with any Released Claim. I will also be prohibited from and refrain from attempting to execute or collect on, or otherwise enforce, any judgment that may be entered against any Released Party in connection with any Released Claim.

Pursuit of Certain Claims. I agree that I will never (i) take any legal or other action to initiate, pursue or maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any of the Released Claims and Liabilities against or from any Released Party; (ii) institute or participate in any new legal action against any Released Party to any extent, or in any way, arising out of, relating to, resulting from and/or connected with my World Trade Center-related rescue, recovery, debris removal and/or clean-up work and/or volunteer service on and/or after September 11, 2001, at the WTC Site or any other location, and/or with any injury I and/or any other Releasing Party have ever claimed, or may at any time hereafter claim was caused in whole or in part by my World Trade Center-related rescue, recovery, debris removal and/or clean-up work and/or volunteer service on and/or after September 11, 2001, at the WTC Site or any other location; or (iii) attempt to execute or collect upon, or otherwise enforce against, any Released Party any judgment relating in any way to my World Trade Center-related rescue, recovery, debris removal and/or clean-up work and/or volunteer service on and/or after September 11, 2001, at the WTC Site or any other location.

Pursuit of Certain Claims. I agree that, upon the effectiveness of the Confidential Release under the terms of the Agreement, I will never (i) take any legal or other action to initiate, pursue or maintain, or otherwise attempt to execute upon, collect or otherwise enforce, any of the Released Claims and Liabilities of or against any Released Party, (ii) institute or participate in any new legal action against any Released Party to any extent, or in any way, arising out of, relating to, resulting from and/or connected with FOSAMAX and any jaw-related injury, including, without limitation, osteonecrosis of the jaw, I (and/or any other Releasing Party) have ever claimed, or may at any time hereafter claim, FOSAMAX caused in whole or in part or (iii) attempt to execute or collect on, or otherwise enforce, any judgment that may be entered against any Released Party in any legal action described in clause (ii) or my pending legal action against Merck.
