QUALIFICATION OF LABORATORIES. 12 All laboratories, including mobile or satellite labs, engaged in sampling or testing of construction 13 materials on the Project must meet the laboratory qualification requirements as presented in 14 Section VI of the ADOT Materials Quality Assurance Program (“Laboratory Qualifications”) prior 15 to being utilized on the Project. 16 Laboratories satisfying these requirements, and the specific test methods for which they are 17 approved, are listed in the ADOT “Directory of Approved Materials Testing Laboratories” 18 (▇▇▇▇▇://▇▇▇.▇▇▇▇▇.▇▇▇), which is updated periodically. The Developer is responsible for 19 confirming the approval status of any laboratories utilized by the Developer, and verifying that 20 laboratories maintain their approval status over the life of their service on the Project.

QUALIFICATION OF LABORATORIES. 13 In the absence of ATTI certification, individuals who currently possess active certification(s) 14 under another state’s certification program may be allowed to perform Project activities that 15 would normally be covered by ATTI certification as part of the acceptance decision on a 16 provisional basis. This provisional status requires prior approval by ADOT on a case-by-case 17 basis, and is only applicable to this Project. In order to request provisional approval, the 18 Developer shall supply the following information to ADOT a minimum of 14 Days before the 19 individual starts sampling and testing on the Project: 20 • Name of the individual 21 • Name of the appropriately certified person who will be supervising the individual’s work 22 • Description of the Work to be performed by the individual, including the type of sampling 23 and testing the individual is expected to perform 24 • List of applicable certifications currently held under another state’s certification program 25 and expiration dates 1 • Differences between the other state certifications and the corresponding ATTI 2 certifications. 3 • Description of how these differences will be managed to avoid errors. 11 appropriate ATTI certification(s) within the time allotted.   • Selection of Labor During the performance of this contract, the contractor shall not use convict labor for any purpose within the limits of a construction project on a Federal-aid highway unless it is labor performed by convicts who are on parole, supervised release, or probation. The term Federal-aid highway does not include roadways functionally classified as local roads or rural minor collectors.

  • Tax Qualification Each Employee Benefit Plan intended to be qualified under Section 401(a) of the Code has been determined to be so qualified by the Internal Revenue Service and nothing has occurred since the date of the last such determination which resulted or is likely to result in the revocation of such determination.

  • Blue Sky Qualification The purchase of Units under this Subscription Agreement is expressly conditioned upon the exemption from qualification of the offer and sale of the Units from applicable federal and state securities laws. The Company shall not be required to qualify this transaction under the securities laws of any jurisdiction and, should qualification be necessary, the Company shall be released from any and all obligations to maintain its offer, and may rescind any sale contracted, in the jurisdiction.

  • STAFF QUALIFICATIONS a) CONTRACTOR shall ensure that all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide classroom and/or individualized instruction or related services hold a license, certificate, permit, or other document equivalent to that which staff in a public school are required to hold in the service rendered consistent with Education Code section 56366.1(n)(1) and are qualified pursuant to Title 5 of the California Code of Regulations sections 3064 and 3065. b) Only those NPS/A located outside of California that employ staff that hold a current valid credential or license to render special education and related services as required by that state shall be eligible to be certified. NPA/NPS staff shall be required to hold credentials and licenses within the state where they are providing services regardless of where the agency is located. c) When CONTRACTOR is a nonpublic school, NPS, an appropriately qualified person shall serve as curricular and instructional leader, and be able to provide leadership, oversight and professional development. The administrator of the NPS holds or is in the process of obtaining one of the following: (A) An administrative credential granted by an accredited postsecondary educational institution and two years of experience with pupils with disabilities.

  • Qualification and Good Standing Each Loan Party is qualified to do business and in good standing in every jurisdiction where its assets are located and wherever necessary to carry out its business and operations, except in jurisdictions where the failure to be so qualified or in good standing has not had and will not have a Material Adverse Effect.
