The "Qualified Laboratories" clause defines the standards and requirements that laboratories must meet to be recognized as acceptable for performing specific tests or analyses under the agreement. Typically, this clause specifies accreditation criteria, such as compliance with ISO standards or certification by relevant authorities, and may require periodic verification of a laboratory's qualifications. Qualified Laboratories. When an out-of-network qualified laboratory provides medically necessary toxicology test results to the referring health care provider within two business days of receipt of the test specimen, the MCOP shall pay that laboratory at least sixty percent of the Medicaid laboratory services fee schedule. ODM defines “within two business days of receipt of the test specimen” as two business days from the time of collection to when the test results are received by the provider. For urine drug screens, the ODM urine drug screen guidelines shall be followed as specified in Appendix G of this Agreement. For the purposes of this requirement, a qualified laboratory is a laboratory that is enrolled with Medicaid as an independent laboratory, and that meets all of the following conditions: 1. Is accredited by the College of American Pathologists; 2. Is approved by the New York Clinical Laboratory Evaluation Program; and 3. Indicates to the MCOP that is it providing services and billing as a qualified laboratory under this requirement. The MCO is not prevented from conducting program integrity activities for any laboratory submitting claims for services under this requirement. For any such work, the requirements in Appendix I and elsewhere of this Agreement (such as deconfliction and other requirements) apply.

  • Child Labor The Contractor represents and warrants that neither it, its parent entities (if any), nor any of the Contractor’s subsidiary or affiliated entities (if any) is engaged in any practice inconsistent with the rights set forth in the Convention on the Rights of the Child, including Article 32 thereof, which, inter alia, requires that a child shall be protected from performing any work that is likely to be hazardous or to interfere with the child’s education, or to be harmful to the child’s health or physical, mental, spiritual, moral, or social development.

  • Substance Abuse Program The SFMTA General Manager or designee will manage all aspects of the FTA-mandated Substance Abuse Program. He/she shall have appointing and removal authority over all personnel working for the Substance Abuse Program personnel, and shall be responsible for the supervision of the SAP.

  • Background Screening VENDOR shall comply with all requirements of Sections 1012.32 and 1012.465, Florida Statutes, and all of its personnel who (1) are to be permitted access to school grounds when students are present, (2) will have direct contact with students, or (3) have access or control of school funds, will successfully complete the background screening required by the referenced statutes and meet the standards established by the statutes. This background screening will be conducted by SBBC in advance of VENDOR or its personnel providing any services under the conditions described in the previous sentence. VENDOR shall bear the cost of acquiring the background screening required by Section 1012.32, Florida Statutes, and any fee imposed by the Florida Department of Law Enforcement to maintain the fingerprints provided with respect to VENDOR and its personnel. The parties agree that the failure of VENDOR to perform any of the duties described in this section shall constitute a material breach of this Agreement entitling SBBC to terminate immediately with no further responsibilities or duties to perform under this Agreement. VENDOR agrees to indemnify and hold harmless SBBC, its officers and employees from any liability in the form of physical or mental injury, death or property damage resulting from VENDOR’s failure to comply with the requirements of this section or with Sections 1012.32 and 1012.465, Florida Statutes.
