Evaluation Program Clause Samples

The Evaluation Program clause defines the terms under which one party is permitted to use another party's products or services for testing, assessment, or trial purposes. Typically, this clause outlines the scope of the evaluation, any restrictions on use, the duration of the evaluation period, and the obligations regarding confidentiality and return or destruction of materials after the evaluation ends. Its core function is to allow potential customers or partners to assess a product or service before committing to a purchase or long-term agreement, while protecting the provider’s intellectual property and limiting liability during the trial period.
Evaluation Program. This is the Evaluation Operations plan presented by THE CONTRACTOR to the ▇▇▇, as per Clause 7 hereto, with the purpose of evaluating a Discovery and determining whether it is a Commercial Field. The performance of the Evaluation Program and submittal of the report on the results to ▇▇▇ are requisites to declare whether a Discovery is a Commercial Field.

The Entity will assist ▇▇▇▇.▇▇▇ and Evaluator in working through the Entity’s standard procedures for obtaining access to data for the purposes of evaluation as detailed below. The Entity may provide the Evaluator with individual student achievement and assessment data and limited demographic data (as detailed below). The Entity may facilitate student participation in survey and interview data collection conducted by the Evaluator. Entity will not provide ▇▇▇▇.▇▇▇ any individual student achievement or demographic data, but will provide ▇▇▇▇.▇▇▇ with classroom and school average scores on ▇▇▇▇.▇▇▇ assessments. Individual student data given to the Evaluator by the Entity shall be de-identified and contain a unique de-identified student number that cannot be used to re-identify the student (for example, a one-way mapped version of the Entity student ID). This de-identified student data will be used solely for the purpose of analyzing student performance over time and contain no personally identifiable student information.
