Requests for Data. The Reorganized Dow Corning and Shareholders along with their Insurers shall at their request and expense, and pursuant to procedures approved by the Claims Office, be afforded access to and permitted to inspect all documentation and other supporting evidence submitted by any Settling Claimants who have been paid as may be necessary for the Debtor and the Shareholders to receive benefits under insurance policies. The Reorganized Dow Corning, Shareholders, and Insurers shall maintain the confidentiality of the Claims information to protect the identity of the Claimants.

Requests for Data. All requests for data shall be in writing. Available and relevant data necessary for the Union to adequately represent its interest will be furnished by the Employer. A reasonable fee may be assessed to cover the cost of furnishing such data.

The Special Master, or this Court in the first instance, shall have 14 authority to determine, by application or by stipulation, among the California 15 Parties, the amount of attorneys' fees and costs to which the office of the Attorney 16 General of the State of California, the CPUC, the California Department of Water 17 Resources, the City of Los Angeles, PG&E and Edison, respectively, may claim 18 out of the total settlement consideration paid by El Paso Corporation, EPNG and 19 Merchant (collectively “El Paso Parties”) under the Master Settlement Agreement 20 (a copy of which is attached to the Stipulation and [proposed] Order as Exhibit A). 21 Any award of fees and costs hereunder shall not increase the amount of 22 consideration paid by the El Paso Parties under the Master Settlement Agreement 23 but shall simply be used as a basis for allocating the portions of said consideration 24 that are payable as fees and costs under the Master Settlement Agreement to the 25 office of the Attorney General of the State of California, the CPUC, the California 26 Department of Water Resources, the City of Los Angeles, PG&E and Edison, 27 respectively.

Requests for Data. In the event Subrecipient receives a third-party request for Data, including any electronic discovery, litigation hold, or discovery searches, Subrecipient shall first give ODHS notice and provide such information as may be reasonably necessary to enable ODHS to protect its interests.

Contractor will: (1) if required by a court of competent jurisdictions or an administrative body to disclose District and/or End User Data, Contractor will notify District in writing immediately upon receiving notice of such requirement and prior to any disclosure; (2) consult with District regarding its response; (3) cooperate with District’s reasonable requests in connection with efforts by District to intervene, quash or modify legal, order, demand, or request; and

Requests for Data. All parties acknowledge that the provision of data takes significant time and resources, and undertake to minimise the impact of data requests, while maximising project’s potential.
