Scheduling of Deliveries. The El Dorado Designated Representative will comply with all forecasting, scheduling and notice requirements contained in Sections 5.2.1, 5.2.2, 5.3, and 5.4 of this Agreement and it will specifically identify for each El Dorado Party the quantity of water delivery being forecasted.
Scheduling of Deliveries. Subject to CCSD’s obligation to purchase Return Water set forth in Section 3.5.1, Cal Am will deliver Return Water to the Delivery Point in quantities and at times determined by the Parties. Cal Am will endeavor to cooperate with CCSD to deliver Return Water to the Delivery Point in volumes and at times requested by CCSD. CCSD will give at least 30 days’ advance written notice to Cal Am by email, facsimile or U.S. Mail before any changes to CCSD’s water demand during any water year.

(a) Deliveries will be made insofar as possible as requested by the Purchaser, all as provided in this Section 7; provided, that such deliveries, together with deliveries requested by all other Purchasers (including deliveries to ▇▇▇▇▇▇▇ pursuant to its reservation under Section 4 hereof) will be possible of fulfillment under the terms of the License and will not exceed the capability of the ▇▇▇▇▇ Project or subject it or its operation to undue hazard.
(b) It is the intent of the parties hereto that the power and energy purchased hereunder by the Purchaser shall be fully coordinated with other resources available to the Purchaser and with the resources of other Purchasers and that the operation of the ▇▇▇▇▇ Project shall be coordinated with the operation of the Northwest Power Pool. Scheduling of generation from the ▇▇▇▇▇ Project shall be as requested by the Purchaser, acting singly or as a member of a group of Purchasers, subject to the limitations set forth in this Section and in other Sections of this contract.
(c) The Purchaser, acting singly or as a member of a group of Purchasers, shall make available to ▇▇▇▇▇▇▇ at least eight (8) hours before 12:01 A.M. of each day an hourly schedule of desired total energy deliveries for that day. Such schedule shall be based upon the probable water supply to the ▇▇▇▇▇ Project and the resulting probable output. Changes in the desired energy deliveries may be made at any time upon the request of the Purchaser if required by changes in estimated river flows or system requirements, and the Purchaser may request that such changes be made continuously through the use of automatic load control equipment. Deviations from schedule for ▇▇▇▇▇ Project Output shall be held to a minimum by ▇▇▇▇▇▇▇ and corrected as promptly as possible on an hourly basis under conditions as nearly equivalent as possible to those obtaining when the deviations occurred.
(d) The schedules and deliveries requested by the Purchaser shall be in accordance with the following:
(1) The Purchaser shall not request the delivery of energy, or equivalent spill, at a rate in excess of an amount determined by multiplying the peaking capability of the ▇▇▇▇▇ Project at the time of such request by the Purchaser’s Power Allocation. Scheduling of Deliveries. Unless the Parties mutually agree otherwise, the Monthly Offtake Quantities for each Month shall be scheduled to ship from the Facility for delivery to Buyer on a weekly basis. Prior to the end of each week, Seller shall deliver to Buyer a forecast of the portion of the Monthly Offtake Quantities anticipated to be shipped from the Facility during the following week (a “Weekly Shipping Forecast”). Each Weekly Shipping Forecast will include the relevant sales order number, the types, specifications and respective quantities of Monthly Offtake Quantities, the relevant product codes, the Delivery Point, and such other information as the Parties mutually agree.

Scheduling of Deliveries. On an annual basis during the Delivery Term, Cal Am shall make available for delivery to Agency for CSIP use the volume of Cal Am’s Annual Return Water Obligation in excess of the CCSD Delivery Volume, if any. If available and requested by Agency, Cal Am will endeavor to cooperate with Agency to deliver Return Water to the Delivery Point in volumes and at times that satisfy Agency’s needs.

For the Striped Bass (in odd years) and the hybrid Striped Bass (annually), the fish shall be delivered in late May or June, but must be delivered prior to the end of June. Striped Bass and hybrid Striped Bass will be delivered to Elephant Butte Lake and or Caballo Lake, NM. The final order will be placed by April 1 of each year.

EID and GDPUD will coordinate with the El Dorado Designated Representative in order that the El Dorado Designated Representative may meet the notice and forecasting requirements contained in sections 5.2.1, 5.2.2, 5.3 and 5.4 of the Cooperation Agreement. EID and GDPUD will provide the El Dorado Designated Representative with the required information five (5) working days before such information must be provided to SMUD.
