Scheduling of Shifts. (a) The employer shall set up a shift schedule which shall cover a minimum period of four (4) weeks, posted two (2) weeks in advance, which will cover the normal requirements of the work area. Once the schedule is posted the employer shall make every reasonable effort not to alter the schedule without consultation with all employees affected by any change being proposed. (b) The staffing, preparation, posting and administration of shift schedules are the responsibility of the employer. (c) Provided sufficient advance notice is given and with the approval of the employer, employees may exchange shifts if there is no increase in cost to the employer. (d) Every reasonable effort shall be made by the employer to consider the wishes of the majority of employees concerned in the arrangement of rotations, shift schedules and shifts within the schedule. Consideration may be given to an employee's request for permanent evening or night duty. (e) An employee who normally rotates on all three (3) shifts shall be scheduled to work the majority of shifts on day duty whenever possible. For purposes of verification, a period of twelve (12) complete weeks commencing with the start of a shift schedule will be used for such longer period as may be mutually agreeable with the staff concerned. ** (f) There shall be a time period of at least sixteen (16) hours elapsing between changes to scheduled shifts. Failure to schedule sixteen (16) hours off without mutual consent will result in premium pay at time and a half (1 ½) the nurse's regular straight time hourly rate. (g) An employee who is required to change his scheduled shift without receiving at least forty-eight (48) hours' notice in advance of the starting time of such change in his scheduled shift, shall be paid for the first (1st) shift worked on the revised schedule at the rate of time and one-half (1 ½). Subsequent shifts worked on the revised schedule shall be paid for at the hourly rate of pay. (h) Notwithstanding anything to the contrary contained in this Agreement, the implementation of any variation in hours (clause B1.03) shall not result in any additional overtime work or additional payment by reason only of such variation, nor shall it be deemed to prohibit the right of the employer to schedule any hours of work permitted by the terms of this Agreement. (i) Within five (5) days of notification of consultation served by either party, the Institute shall notify the employer in writing of the representative authorized to act on behalf of the Institute for consultation purposes. (j) When operational requirements permit, two (2) paid rest periods of fifteen (15) minutes each shall be provided during each work day. ** (k) An employee shall not be scheduled to work in excess of fifty-two and one-half (52 ½) hours without at least two (2) consecutive days of rest. Premium pay at time and a half (1 ½) the nurse's regular straight time hourly rate shall be paid for each subsequent consecutive hours worked in excess of fifty-two and one-half (52 ½) hours until the nurse is scheduled off. (l) Where operational requirements permit, the employer shall not schedule an employee to work both December 25 and January 1 in the same holiday season unless specifically requested by the employee.

Subsequent shifts worked on the revised schedule shall be paid for at the hourly rate of pay.
(h) Notwithstanding anything to the contrary contained in this Agreement, the implementation of any variation in hours (clause B1.03) shall not result in any additional overtime work or additional payment by reason only of such variation, nor shall it be deemed to prohibit the right of the employer to schedule any hours of work permitted by the terms of this Agreement.
(i) Within five (5) days of notification of consultation served by either party, the Institute shall notify the employer in writing of the representative authorized to act on behalf of the Institute for consultation purposes.
(j) When operational requirements permit, two (2) paid rest periods of fifteen (15) minutes each shall be provided during each work day. **.

In such cases, the Employee will perform the job of the Employee with whom he exchanged and shall retain his/her own seniority in the start event of a shift schedule lay off during the exchange.
9. A press shall not operate without a full crew for more than one (1) hour. However, if an Assistant does not report for work as scheduled and no other Assistant is available, the Pressperson will be used for expected to perform the required make ready only. The provision of Article 14 – Report Allowance, prevails in any event.
10. When an Employee is absent during the week due to a one (1) day vacation, floating holiday, sickness, etc., an Employee on the same shift in accordance with seniority and qualifications will fill his/her position. If there is someone on lay off, they will be brought in to fill the resulting vacancy.

(g) An employee who is required to change his scheduled shift without receiving at least forty-eight (48) hours' notice in advance of the starting time of such change in his scheduled vacancy on another shift, shall be paid for the first (1st) shift worked surplus junior Employee, in accordance with seniority and qualifications, on the revised schedule at shift having the rate of time and one-half (1 ½). Subsequent shifts worked on the revised schedule shall extra Employee will be paid for at the hourly rate of pay.
(h) Notwithstanding anything transferred to the contrary contained in this Agreement, shift having the implementation of any variation in hours (clause B1.03) shall not result in any additional overtime work or additional payment by reason only of such variation, nor shall it be deemed to prohibit the right of the employer to schedule any hours of work permitted by the terms vacancy.
