Scope of Work of the Contract. The scope of design and construction phase services required is consistent with the County’s current standard Design-Build Services Agreement. The Design-Builder will take the lead role for design phase services and will hold the construction contract with the County for construction of the Project. Design phase services are anticipated to include architectural, structural, mechanical, electrical, plumbing, security, audio visual, environmental remediation, demolition and disposal related work. The design plans must meet ALL County of Merced Codes, Standards, County reviews, approvals and permitting. Prior to construction, the Design-Builder will assume the risk of delivering the Project through a Final Guaranteed Maximum Price (“Final GMP”). The cost of the work necessary to complete sixty percent (60%) of the Project design and to establish the Final GMP in accordance with Section 1.3 below shall not exceed Eight Hundred Ninety-Two Thousand, Nine Hundred Ninety-Seven Dollars and No Cents ($892,997.00). Once the Final GMP is established in accordance with Section 1.3, the parties shall amend this Agreement to memorialize the Final GMP. Once Contractor has fully completed all construction plans and specifications and prior to County’s issuance of a Notice to Proceed for the construction phase of the Project, Contractor shall furnish all bonds required by this Agreement, including but not limited to a construction performance bond and a construction labor and material payment bond, in the amount of one-hundred percent (100%) of the construction-related portion of the Final GMP. Contractor’s failure to timely furnish said bonds shall constitute a breach of this Agreement and shall entitle County to pursue against Contractor all remedies available under this Agreement or otherwise available at law or in equity. The Design-Builder will be responsible for construction means and methods and will be required to solicit bids from pre-qualified subcontractors to perform the work. The Design-Builder will not be required to self-perform the work and may subcontract any portion of the work through a competitive bidding process.
