Stand-By Pay. A. Definitions
1. “Stand-by status” is a condition of employment whereby an employee is designated by his/her department to be ready to be engaged in work. The employee must be in readiness to perform actual work when the need arises or when called. Employees on stand-by status are required to be available by telephone, radio, or pager when on stand-by.
2. “Stand-by pay” is the compensation paid to employees who are assigned to stand-by duty and who are required by their respective supervisors to remain available to report to work during and for a specified period of time beyond the employees’ assigned work period.
B. Employees designated by a supervisor to remain available for work in a stand-by status shall be compensated at an hourly rate of fifteen percent (15%) of their regular hourly rate.
C. An employee in authorized stand-by status must provide the Employer with a telephone number where the employee may be reached, or make himself or herself available and able to be contacted through a communication device (e.g. radio or pager).
D. Assignment to authorized stand-by status includes the following conditions:
1. The requirement must be definite and the employee must be officially notified by the supervisor to remain on stand-by status;
2. The requirement must be continuous until such time as the employee is actually per- forming work, reporting for a scheduled work period, or specifically relieved from stand-by status;
3. Supervisors placing an employee on stand-by will advise the employee of the reason for the stand-by, and the approximate duration of the stand-by. When placed on stand-by an employee must be able to respond within a “reasonable period of time.” In determining what constitutes a “reasonable period of time” for a given employee to respond when in stand-by status, the Employer will take into consideration the distance of the employee’s residence from the location to which the employee must report, the time of day the employee is called back to duty (for the purpose of assessing traffic conditions), weather conditions, and other legitimate factors likely to affect the employee’s response time. Further, when the stand-by is lifted, the supervisor will re-contact the employee and so advice the employee.
E. An employee shall not be eligible for stand-by pay while in callback, overtime or regular pay status.
F. Once an employee on stand-by status is directed to report for duty, he or she shall be compensated at the overtime rate of time and ...
Stand-By Pay. An employee is entitled to stand-by pay if he/she is required by the Agency in writing to be on stand-by, that is, to be available for possible call to work. If it is not practical to notify an employee in writing regarding stand-by status, the Employer may utilize oral or telephone means. Standby status may be canceled by telephone, providing written notice of such cancellation is provided to the employee within forty-eight (48) hours. An employee entitled to stand-by pay shall receive twenty-five percent (25%) of his/her base rate of pay for each hour he/she is in stand-by status. Standby time will be excluded from overtime calculation. Stand-By status shall be distinguished from Call- Back status by the following: 1) Direct notice of the requirement, as in the preceding; 2) Employee’s off-duty activities are specifically restricted by the Employer; 3) Employee is given a specific period of time during which he/she must respond to any summons from the Employer with the consequence of discipline for failure to respond/report. Once summoned to report, Stand-By pay will continue until the employee reports and actual work is performed, at which time the pay provisions of the Call-Back Section (Section 13.08) will apply and Stand-By pay will cease. An employee required to carry a pager while “on-call” is not in Stand-By status unless specifically notified that he/she is to be on “Stand- By” status.
Stand-By Pay. Employees are entitled to stand-by pay if required to remain on the Employer’s premises or so close thereto that the employee cannot use the time effectively for his/her own purposes. Stand-by payment shall be at the regular, or overtime rate of pay, whichever is applicable. An employee who is not required to remain on the Employer’s premises but is merely required to leave word at his/her home or with the Employer where he/she may be reached is not working while on call. If an employee is called back to work, the provisions of Section 2 apply. Any employee who is place on call shall not be required to perform any duties the employee is not qualified to perform.
Stand-By Pay. A. A bargaining unit employee who is directed by the Chief or other command personnel, to restrict off-duty activities to be immediately available for duty will receive compensation in accordance with this Article for the entire time they are required to perform standby duties.
B. Employees will be assigned standby as determined by the Chief or other command personnel.
C. With approval of the Chief or other command personnel employees assigned to standby status may be relieved for any portion of the assignment if a replacement is available. The person providing relief is responsible for meeting all standby obligations.
Stand-By Pay. Notwithstanding Article 8.6(e) the City offers two (2) days off to be granted to designated employees in lieu of standby for one (1) full calendar week of standby duty (a week is defined as 4:30 P.M. Friday to 4:30 P.M. the following Friday). In addition, Twenty Dollars ($20.00) shall be given for standby on statutory holidays for a 24-hour statutory holiday period, notwithstanding Article 8, Section 6(e).
Stand-By Pay. Employees required to restrict their off-duty activities in order to be immediately available for duty when called, will be compensated for time spent in standby status. Rate of compensation for standby status will be compensated at a rate of $1.00 per hour. Employees who, on the effective date of this Agreement, receive standby in excess of those rates shall continue to do so. In addition to the pay received while on standby, an employee called to work will be paid at his/her regular salary for all hours worked.
Stand-By Pay. Employees required by Management assignment to remain on stand-by duty, subject to call-in, shall be paid a minimum of four (4) hours per day (or one-half [½] of a day's pay, whichever is greater) during the employee's assigned work week and a full day's pay per day on off-duty days unless such employee is called and released from such stand-by assignment by Management prior to the beginning of stand-by duty. All stand-by pay shall be paid at the existing straight time rate of pay. Employees who are called in while on stand-by shall receive stand-by compensation for only those actual hours they were on stand-by.
Stand-By Pay. When the Agency places an employee on stand-by duty, the employee is required:
1. To be ready to respond immediately to calls for service;
2. To be reachable by telephone/pager;
3. To be available to utilize any appropriate type of electronic or computerized means of response, including SCADA, smartphones, and mobile computers;
4. To remain within a reasonable distance of the work location; and
5. To refrain from activities that might impair his/her ability to perform assigned duties. Employees shall be compensated for stand-by duty at the rate of $65.00 per day for all days other than weekends and holidays and at the rate of $80.00 for weekends and holidays, for 24 hours of stand-by duty, or any portion thereof. Such pay shall be paid in the pay period earned. In addition, if an employee on stand-by duty is called to duty, he or she shall be paid at the overtime rate for a two- (2) hour minimum or the time actually worked, whichever is greater.
Stand-By Pay. 152. Employees who, as part of the duties of their positions are required by the appointing officer to standby when normally off duty to be instantly available on call for the performance of their regular duties, shall be paid the federal minimum wage per hour for the period of such standby service. The issuance of an electronic paging device does not in itself constitute eligibility for standby pay. When such employees are called to perform their regular duties during the period of such standby service, they shall be paid while engaged in such service the usual rate of pay for such service as provided herein. Standby pay shall not be allowed for performing duties which are primarily administrative in nature.
Stand-By Pay. An employee who is required to remain on call or stand-by, on completion of their regular hours of work or while on regularly scheduled days off, shall be paid a premium of $2.50 for each hour or portion thereof they are required to stand-by or remain on call. All stand-by duties shall be authorized and scheduled by the Employer and no compensation shall be granted for the period of stand-by if the employee does not report for work when required.
