2.9 UNIT PRICING:
2.9.1 All pricing is for “installed” and accepted quantities. Costs that exceed the approved purchase order will be processed by change order. All change orders to a project shall be submitted in writing, referencing the contract serial number, and be approved by MCDOT (or user agency if request was made by them) prior to any authorization to proceed. A Contractor who fails to acquire prior approval by email or in writing of change orders runs the risk of incurring these additional costs without payment.
2.9.2 The unit price for each item includes the cost of all related work, bonding, and taxes as indicated in specification Section 109.2 SCOPE OF PAYMENT.

Standard Details. The Engineer will use the latest TxDOT standard details for beams, diaphragms, railings, expansion joints, riprap, etc. wherever possible. Prepare any project-specific modified standards necessary for inclusion in the PS&E package. Sign, seal and date all project-specific modified standards.
Standard Details. This subcontractor is responsible for reviewing Contractor’s Standard Details. These details are made a part of this subcontract agreement. If more stringent or conflicting contract specifications or details are shown on contract documents , it is this trade’s responsibility to confirm with Contractor’s Project Manager which detail shall govern.

The Transfer of Ownership in the Work Product as described in Section 15.2 does not include design details developed by A/E and/or A/E’s Consultants which are not unique to the Project (collectively, “Standard Details”). A/E and/or A/E’s Consultants shall be entitled to use their respective Standard Details on other projects; provided, however, A/E and A/E’s Consultants shall not use their respective Standard Details in any manner which, taken independently or in combination, would produce another project with the same overall appearance of Owner’s Project. Concurrent with the incremental Transfer of Ownership, Owner shall be granted an irrevocable, non-exclusive, royalty-free license to use the Standard Details as reasonably necessary in connection with the construction, renovation, extension, expansion, repair, occupancy, operation and maintenance of the Project, and all other permitted uses. Owner shall not, except as required by any source of financing for this Project, assign, delegate, sublicense, pledge or otherwise transfer any license granted herein to another party without the prior written agreement of A/E. Any use of the A/E’s Work Product without the involvement of A/E shall be at Owner’s sole risk and without liability to A/E and A/E’s Consultants, except as provided in Section 15.4.1.
