The Grievance Procedure. (a) Step 1 (Immediate Supervisor) An Employee who has a grievance shall, within ten (10) days of the date she becomes aware of, or reasonably should have become aware of, the occurrence which led to the grievance, first discuss the matter with her immediate supervisor and attempt to resolve the grievance at this stage. If the grievance is not settled at this stage, it may be advanced to Step 3. The Chief Operating Officer Senior Vice-President, Human Resources shall not be involved in a conflict of interest or an apprehension of bias shall not exist or be apparent for the matter to be heard by the Senior Vice-President, Human Resources. The Senior Vice-President, Human Resources or designate shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have a representative of the Union present during the meeting. The Chief Operating Officer Senior Vice-President, Human Resources or designate shall render a written decision within ten (10) days of the date of the hearing. The Grievance procedure from Step 1 to Step 3 shall never exceed sixty (60) days. In the event the Employer fails to process the grievance procedure within the 60 day period, the grievance is automatically referred to arbitration for settlement and resolution. The Grievance Procedure. (a) Step 1 (Immediate Supervisor) An Employee who has A. Purpose - The purpose of this agreement is to secure at the lowest possible administrative level, reasonable and equitable resolution of alleged grievances which may from time to time arise involving the interpretation and/or application of the negotiated agreement.
B. Procedure - Since it is important that grievances be processed as rapidly as possible, the number of days indicated at each level in this

If, in the judgment of the Association, a grievance shallaffects a group or class of members of the bargaining unit or is beyond the scope of the immediate first-line supervisor, the Association may begin processing the grievance within fifteen (15) days in writing at the Superintendent’s level. PRIOR LEVEL I - Before the submission of a grievance, the aggrieved party must attempt to resolve the problem by discussing the matter directly with his/her immediate first-line supervisor within fifteen (15) days after the occurrence of the alleged grievance. In case of the absence from school of the first-line supervisor for two consecutive days, the grievant will proceed directly to Level I. LEVEL I - If the aggrieved party is not satisfied with the disposition of his/her grievance after the informal discussion with his/her immediate first-line supervisor and if he/she desires further action, said person or persons initiating the alleged grievance shall present the grievance in writing, on the approved form provided by the employer for this purpose, to the building principal or other first-level supervisor within ten (10) days after completion of Prior Level I. LEVEL II - If the date she becomes aware of, or reasonably should have become aware of, the occurrence which led to the grievance, first discuss the matter with her immediate supervisor and attempt action taken at Level I fails to resolve the grievance at this stage. (c) Step 3 (Chief Operating Officer) Within ten (10) days of after referral by the reply at Step 2grievant, the Employee Superintendent shall submit meet with the grievance, in writing to the Chief Operating Officer or designate. The Chief Operating Officer or designate shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have grievant and a representative of the Union present during employee organization to consider the meetingalleged grievance and to make every attempt to resolve it. The Chief Operating Officer or designate Superintendent shall render a indicate his/her disposition of the alleged grievance in writing within five (5) days after said meeting (one copy for the grievant, one copy for the association) LEVEL III - If the action taken at Level II fails to resolve the grievance to the satisfaction of the affected parties, the grievance shall be referred in writing by the grievant to the Board of Education within three (3) days after reviewing the written decision report of the Superintendent. The Board of Education shall meet with the grievant and the representative committee of the employee organization within ten fifteen (1015) days of the date request of the grievant for the purpose of discussing the grievance and disposing of it in a mutually satisfactory manner. The Board of Education shall make a disposition in writing (one copy to the grievant and one copy to the Association) of the grievance within seven (7) days after the hearing. LEVEL IV - If the action at Level III fails to resolve a grievance is not settled at this stage, either party may decide to proceed to Arbitration or by mutual involving the interpretation and/or application of the negotiated agreement to Mediation.
(d) A copy the satisfaction of the written Association, the grievance may, at Step 2 and Step 3 shall the discretion of the Association, be submitted referred to binding arbitration as provided in Section 903 of the Executive Director, Human ResourcesAct.

(ii) If the grievance is a group grievance, it this Agreement shall be submitted in writing at step 2 adjusted and settled as follows: The employee may request his Supervisor to the Centre Administrator or designate within ten (10) days of the date any of the aggrieved Parties became aware of the event or reasonably should have become aware of the event leading call his shop ▇▇▇▇▇▇▇ to handle the grievance. (c) Step 3 (Chief Operating Officer) Within ten (10) days writing on an Employee Grievance Form stating the nature of the reply at Step 2, the Employee shall submit the grievance, the remedy sought and the section or sections of the Agreement which are alleged to have been violated, and signed by the employee involved and one copy given to the Supervisor. The Supervisor shall give his reply in writing on the Employee Grievance Form to the Chief Operating Officer employee, with a copy to the UNION, without undue delay but, in any event, no later than two (2) workdays following that on which the written grievance was received by the employee's Supervisor. lodged by the shop ▇▇▇▇▇▇▇ within two (2) workdays thereafter to the Department Manager or his designate. The Grievance Procedure. (ii) If the grievance is a group grievance, it shall be submitted in writing at step 2 to the Centre Administrator or designate within ten (10) days of the date any of the aggrieved Parties became aware of the event or reasonably should have become aware of the event leading to the grievance. (iii) the grievance shall be submitted, in writing, to the Director of Operations or designated representative, (1) stating the article(sArticle(s) claimed to have been violated, (2) the nature of the grievance and (particulars of the facts giving rise to the grievance), (3) the redress sought. The Administrator (particulars of the Centre shall hold a hearing within ten remedy) sought and (104) days of receipt the signature of the grievance. The grievance will be responded to, in writing, by the Centre Administrator or designate Manager hearing the grievance within ten (10) days of the grievance hearing at step 2.
