Time for Performance of the Work. The Work will begin within ten (10) days of receipt of the Notice to Proceed from the Town.
Time for Performance of the Work. The Work shall be completed within one hundred and two (102) calendar days of receipt of the Notice to Proceed from the Town.
Time for Performance of the Work. Contractor shall carry out and complete the Work on or before the Milestone Dates inserted in the Project Schedule and listed in Exhibit B. Should the Work fall behind to such extent that the respective Milestone Dates may, as determined by Owner or Owner’s Representative in consultation with Contractor, be at risk, Contractor shall propose to Owner and Owner’s Representative, within five (5) Days of determining that any Milestone Date may be at risk, another course of action that will return the Project to a state of Schedule compliance to meet the remaining Milestone Dates contained in the Contract Documents. Such recovery Schedule may include re-planning task sequences, increasing personnel or other resources of Contractor or of any Subcontractor employed on the Work, increasing the number of shifts, overtime operations, the addition of Subcontractors or other steps to cause the recovery of the progress of the Work. Contractor shall not be entitled to any additional payment for taking any such steps. Should Owner or Owner’s Representative reasonably believe that Contractor’s proposed course of action is not sufficient to restore the Work to meet the Milestone Dates, Owner shall advise Contractor that Contractor has five (5) Days to correct the schedule problem and recover the time on the Project Critical Path or to make arrangements, acceptable to Owner and Owner’s Representative, to correct the schedule problem and recover the time on the Project Critical Path. If Contractor has not corrected the schedule problem or does not have a reasonably acceptable plan to correct the schedule problem within such time, Owner shall have the right, following consultation with Contractor as to the most appropriate method, to require Contractor to increase the number of its employees, or to increase or change the amount or kind of tools or equipment or to increase the time worked by the employees until the Work is back on schedule or a plan for regaining the schedule reasonably acceptable to Owner is proposed by Contractor or any combination thereof. Costs for such Work shall be paid by Contractor if such delay has been caused by the Contractor.
Time for Performance of the Work. 4.1. Time is of the essence of this agreement. Subcontractor shall begin the Work when directed by Contractor and shall perform the Work in the sequence and within the durations stated by Contractor and established by Contractor’s schedule or work plan. Subcontractor acknowledges and agrees that Contractor may occasionally or regularly revise and amend the work plan or the schedule to reflect the needs of the Project, and Subcontractor agrees to perform the Work in the revised sequence and within the revised durations stated by Contractor and/or established in Contractor’s updated or revised work plan or schedule, both of which might include acceleration at no additional cost, unless and to the extent the Owner has actually paid the additional cost. Subcontractor shall keep itself abreast of the work plan and schedule and all work plan and schedule updates, and to this end Subcontractor acknowledges that the current version of the work plan and schedule are available on the Project site and/or from Contractor upon request. 4.2. Subcontractor’s failure to perform and complete the Work in the sequences and within the durations in Contractor’s work plan and schedule, whether original, updated, or revised, shall constitute a material default. 4.3. The Subcontractor shall at all times cooperate with the Contractor, other subcontractors, the Owner, and separate contractors whose work might interfere with the Subcontractor’s Work. Subcontractor shall participate and cooperate with Contractor in preparing the work plan and the schedule and in establishing the times, sequences, and durations required to perform the Work. Subcontractor shall perform its Work to avoid conflict and delay in or interference with the activities of the Contractor, other subcontractors, the Owner, or separate contractors on the Project. 4.4. Subcontractor’s sole and exclusive remedy in the event the Work or its activities are extended, delayed, or interfered with due to any cause, including acts or omissions of Contractor, shall be an extension of time for performance of the Work to the extent such an extension is received by the Contractor, unless Owner agrees to pay additional compensation to Contractor under the Prime Contract in connection with Subcontractor’s request for same. Time for Performance of the Work. At the time that this Contract is signed, the parties contemplate that the Work shall commenceand continue on the periodic basisdefined in the estimate attached hereto (“Work Periods”). The Contract shall remain in effect until cancelled as provided in paragraph 21 below.
