Trade Practices Act Sample Clauses

The 'trade practices act' clause is designed to ensure that the contract complies with relevant consumer protection and fair trading laws, such as those found in the Trade Practices Act or its modern equivalents. This clause typically clarifies that nothing in the agreement limits or excludes rights, warranties, or remedies that cannot be lawfully excluded under applicable legislation. For example, it may specify that statutory guarantees regarding goods or services remain in force regardless of the contract's other terms. Its core function is to protect parties—especially consumers—from unfair contract terms and to ensure the contract does not attempt to override mandatory legal protections.
