The 'Trade Union Representatives' clause defines the rights and roles of employees who are designated as representatives of a trade union within the workplace. Trade Union Representatives. For the purposes of this agreement, the term “trade union representatives” includes workplace representatives, health and safety representatives and learning representatives. Trade union representatives will be appointed in accordance with the rules of the individual trade unions concerned. The Trade Unions will inform the Trust schools in writing of the names of their appointed representatives. The numbers of trade union representatives appointed shall be a matter for each union but the Trade Unions agree that the numbers shall be reasonable in relation to the number of members represented. The Trust will not decline to recognise appointed trade union representatives where their numbers are reasonable in relation to the number of members represented. Trade union members shall be entitled to be represented by employed officials or local representatives of the trade union, in accordance with the provisions of the any relevant school policy and statutory provisions for representation. The Trade Unions commit to providing their members with any reasonably requested representation as soon as possible and ideally within 5 working days of such a request. The Trust undertakes that where it is within their control, no trade union representatives will suffer any disadvantage as a result of undertaking this role on behalf of trade union members.

(a) all such leave shall be subject to the operational requirements of the workplace;
(b) in the case of employers employing five or fewer employees, the union shall give the employer ten days' written notice of the activity for which it seeks time off in terms of this clause;
(c) in the case of employers not referred to in paragraph (b), the union shall give the employer one days' notice of the activity for which it seeks time off in terms of this clause; and
(d) all leave granted in terms of this clause shall be used to attend bona fide industry-related trade union activities.

Trade union representatives will be appointed/elected in accordance with the rules for the individual trade union concerned. The numbers of trade union representatives appointed/elected shall be a matter for each union but the trade unions agree that the numbers shall be reasonable in relation to the number of members represented. The Trust will not decline to recognise appointed trade union representatives. Trade union members shall be entitled to be represented by employed officials or local representation of the trade union, where the trade union considers this to be necessary in the circumstances. The Trust undertakes that no trade union representatives will suffer any disadvantage as a result of undertaking this role on behalf of trade union members.

(2) Shopstewards Time Off
(a) For all areas, paid time off for head shop stewards for union activities shall be improved by 1 additional day’s pay per annum. Any day or part thereof used for attending bargaining council or related meetings shall not be debited from normal shop stewards time off for trade union activities. Payment for such days or hours shall be the responsibility of the relevant regional chamber of the NBC.

9.2. The constitution of the respective registered and admitted trade unions governs the nomination, election, term of office and removal from office of a trade union representative.
9.3. A registered and admitted trade union shall be entitled to elect representatives at the place of work based on the formula above.
9.4. Representatives of registered and admitted trade unions elected in terms of this agreement will be formally recognized once the union has informed management in writing of the names of the elected union representatives.
Trade Union Representatives. 7.1 For the purposes of this Agreement, the term ‘trade union representatives’ are accredited officers.
7.2 Trade union representatives will be appointed in accordance with the rules of the individual trade unions concerned. The trade unions will inform The Everyone Matters Schools Trust in writing of the names of their appointed representatives.
7.3 The numbers of trade union representatives appointed to attend the JCNC shall be a matter for each union, but the trade unions agree that the numbers shall be reasonable in relation to the number of members represented. This will not usually be more than one representative per union unless there are exceptional circumstances, it is agreed in advance of the meeting by both parties and is not to the detriment to the operation of The Everyone Matters Schools Trust, for example if this would cause teachers to miss lessons.
7.4 The Everyone Matters Schools Trust undertake that no trade union representatives will suffer any disadvantage as a result of undertaking this role on behalf of trade union members.

3.2 Trade union representatives will be appointed/elected in accordance with the rules of the individual trade unions concerned. The trade unions will inform the Trust in writing of the names of their appointed representatives.
3.3 The number of trade union representatives appointed/elected shall be a matter for each union but the trade unions agree that the numbers shall be reasonable in relation to the number of members represented. The Trust will not decline to recognise appointed trade union representatives.
3.4 Trade union members shall be entitled to be represented by employed officials or local representatives of the trade union, where the trade union considers this to be necessary in the circumstances. Whether that official is employed by the union or locally elected is a matter for the trade union.
3.5 The Trust undertakes that no trade union representatives will suffer any disadvantage as a result of undertaking this role on behalf of trade union members.
3.6 The Trust will encourage each of its constituent workplaces to establish JNCC arrangements for the consideration of issues specific to the individual workplace.

The Trust will not decline to recognise appointed workplace trade union representatives where their numbers are reasonable in relation to the number of members represented within that academy.
3.4 Trade union members shall be entitled to be represented by employed workplace representatives , local representatives or regional officials of the trade union.
3.5 The Trust values the contribution made by trade union representatives and their skills and experience and undertakes that no trade union representatives will suffer any disadvantage as a result of undertaking this role on behalf of trade union members.
