Common use of Transfer Outside of Bargaining Unit Clause in Contracts

Transfer Outside of Bargaining Unit. No employee will be transferred to a position outside the bargaining unit without the employee’s consent. If such a transfer does take place, the employee shall retain the employee’s seniority acquired to the date of the transfer, for a period of up to two (2) years but will not accumulate any further seniority. If such an employee later returns to the bargaining unit, the employee shall be placed in a job consistent with that employee’s seniority, and the employee’s return shall not result in the lay-off or bumping of an employee holding greater seniority.
