Common use of Transfer Outside of Bargaining Unit Clause in Contracts

Transfer Outside of Bargaining Unit. In the event of a temporary transfer to a position outside the bargaining unit, the Employee shall accrue seniority within the bargaining unit for a period of up to six (6) months. During this six (6) month period the Employee shall pay Union dues. The Employee shall have the right to return to his/her position in the bargaining unit at any time during the six (6) month period with full seniority. Thereafter the Employee's seniority shall be frozen. Seniority shall cease twelve (12) months after the Employee leaves the bargaining unit. Before a temporary transfer to a position outside the bargaining unit may be renewed the position must first be posted and the previous holder of the temporary position must return to the bargaining unit for a period of at least ten (10) working days. The Union shall be informed of the return to the bargaining unit by the Employer of an Employee from a position outside the unit.
