Common use of Transfer Outside of Bargaining Unit Clause in Contracts

Transfer Outside of Bargaining Unit. (a) No employee shall be transferred to a position outside of the bargaining unit without his/her consent. (b) The maximum period of time an employee may be transferred out of the bargaining unit and retain the right to return to their former position shall be twelve (12) months except in the case of replacing someone on a pregnancy and/or parental leave where in such case the maximum period of time shall be sixteen (16) months. (c) An employee transferred outside of the bargaining unit shall not pay union dues and shall not accrue seniority. In the event that he/she is returned to the bargaining unit within the period(s) set out in paragraph (b) above any seniority held at the time of transfer shall be reinstated.
