Transfer/Reassignment Clause Samples
The Transfer/Reassignment clause governs the conditions under which a party may transfer or assign its rights and obligations under the agreement to another party. Typically, this clause specifies whether such transfers require the prior written consent of the other party, and may outline exceptions, such as transfers to affiliates or in connection with a merger or sale of business. Its core function is to maintain control over who is involved in the contractual relationship, thereby preventing unwanted or unapproved parties from assuming contractual rights or responsibilities.
Transfer/Reassignment. The student may, after written approval from the Department, move to another residence hall space, • No unapproved transfers: The student shall not be permitted to transfer to another housing space without the approval of the Department. If the student does occupy another housing space without the approval of the Department, they will be responsible for the rental fees of both the room they moved to and the room they are assigned.
Transfer/Reassignment. Employees who transfer or are reassigned to a position within their class or within their range will retain their current base salary.
Transfer/Reassignment. A transfer/reassignment refers to any action by the Employer which results in the movement of a Unit Member from the position held immediately preceding such action to a position under a different Immediate Supervisor. A transfer/reassignment may be Unit Member initiated (voluntary) or Employer initiated (involuntary).

Transfer/Reassignment. A transfer shall be defined as being voluntarily moved from a position in one (1) building within the District or Academic Cooperative to a position in another building within the District or Academic Cooperative. A reassignment shall be defined as a change from one assignment to another assignment in the same building.
Transfer/Reassignment. A. A “transfer” is a movement of a tenure track bargaining unit member from one college to another. A “reassignment” is a movement of a tenure track bargaining unit member from one division or department to another division or department within a college. A “division” or “department” is a multi-disciplinary grouping containing related academic disciplines as established by the District. A department may also consist of a single discipline. (During 92-93 there were seven (7) divisions at Valley College and seven (7) departments or divisions at ▇▇▇▇▇▇▇ Hills College.) Nothing in this Article shall be interpreted as a restriction on the right of the District to change its organizational structure(s). The District has the right to transfer or reassign bargaining unit members as long as any such transfer or reassignment does not violate the specific provisions of this Article.
B. A transfer/reassignment may be initiated by a Bargaining Unit Member (voluntary) or by the District (Administrative).
C. The District will consider all requests under this Article for voluntary transfer/reassignment from current unit members who meet minimum qualifications.
D. A voluntary transfer/reassignment shall be based upon the following considerations: Required minimum qualifications as specified in any job posting pursuant to state education law, regulation or Education Code Section 87369. Consultation with the College President and with the Department or Division and its faculty. Recentness of acquired knowledge and/or demonstrated competence based on evaluations and/or recommendations in the subject field or position. Additional job-related qualifications as compared to other applicants. Seniority in the District. Ability to perform all required tasks of the specific vacancy as specified by the job description. Ability to work with immediate supervisor(s) and any co-workers, and ability to perform with assigned students. Criteria shall not be applied in an arbitrary or capricious manner.
E. If requested by a unit member, a conference will be held between the administrator who denied the request for voluntary transfer/reassignment and the unit member to discuss the reason(s) for the denial of the voluntary transfer/reassignment. At the request of the unit member, an Association representative may attend the conference. The unit member may request and shall receive written reasons for the denial following said meeting.

Transfer/Reassignment. The District shall not deny any unit member serving in a special education 7 assignment who has fulfilled all of their credential requirements the right to transfer or be reassigned to a 8 vacant position, for which the unit member is qualified, due to the unit member possessing a special education 9 credential.
Transfer/Reassignment. The District recognizes the Union’s interest that employees be given consideration for voluntary lateral transfer/reassignment. The Union recognizes the District’s right to laterally assign personnel system-wide shall not be unduly restricted and is an essential element in managing the operations of the District. Employees are encouraged to inform Management of their interest in voluntary lateral transfer/reassignment. Such requests for voluntary transfer/reassignment shall be considered by Management in filling vacancies wherever practicable and consistent with operational and or administrative requirements as determined by the District. Compensation and benefits in such lateral transfer/reassignment shall be commensurate with the level of work to which the employee is assigned. The parties recognize that involuntary lateral transfers/ reassignments may occur. In such instances, the transfer/ reassignment shall be based solely on the operational needs of the District and not for punitive or disciplinary reasons. Selection of individuals for involuntary transfer/reassignment shall be based on consideration of his/her qualifications, experience, and wherever practical and feasible, the interest of the employee shall be taken into account. The involuntary transfer/reassignment shall not result in a loss of seniority to the employee. The reasons for the involuntary transfer/reassignment shall be explained to the affected employee. The parties further recognize that nothing in this understanding precludes the District from making involuntary demotions or downgrades of positions which may result in a reduction in pay and benefits to the affected employee.
Transfer/Reassignment. 12.6.1 The District shall transfer and/or reassign a qualified unit member subject to layoff to a vacant position at an equal or lower salary level with the agreement of the unit member. Such transfers/reassignment made in order to avoid layoff shall supersede the provisions of Article XIII. If the transfer/reassignment is to a lower-paying class, it shall be considered as a voluntary demotion. The District shall determine qualifications for purposes of this Section.
