Common use of TRANSFERRING OUT OF THE BARGAINING UNIT Clause in Contracts

TRANSFERRING OUT OF THE BARGAINING UNIT. (a) If an Employee is transferred to a position outside of the Bargaining Unit, s/he shall retain her/his seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. If the employee returns to the Bargaining Unit within six (6) months, s/he shall be placed in a job consistent with her/his seniority, provided such return shall not result in the lay-off or bumping of an Employee holding greater seniority. If the employee does not return within six (6) months, seniority is forfeited. (b) No Employee shall be transferred to a position outside the Bargaining Unit without her/his consent.
