Union Security and Rights. 9.01 All Employees who are members of the Union, shall, as a condition of employment, maintain their Union membership and all new Employees, as a condition of employment, become members of the Union from the first day of employment.
9.02 At the time of hiring, the Employer agrees to provide to all new Employees a copy of the current Collective Agreement and any applicable Employer policies and brochures. An Officer of the Union shall be given the opportunity to welcome each new Employee within regular working hours for the purpose of acquainting the new Employee with benefits, duties and responsibilities of Union membership.
(a) Each Employee of the Union shall be provided with a copy of the Collective Agreement electronically within forty-five (45) calendar days of the signing of the Agreement.
(b) A printed copy shall be available upon request.
(c) Each applicant, when accepted for employment, shall be provided with a copy of the Collective Agreement at the Employer expense.
9.04 With the prior permission of the Employer, the Bargaining Unit may hold meetings on the Employer’s property without charge, provided such meetings do not interfere with the operations of the building in which they are held.
9.05 The Employer recognizes members of the Bargaining Unit Negotiating Team as being actively at work where joint negotiations are held during working hours. The Negotiating Team will include up to five (5) members of the Bargaining Unit including the President and may include representatives or agents of District 11 O.S.S.T.F. and representatives or agents of O.S.S.T.F..
9.06 Any representative of the Bargaining Unit required to represent Employees at meetings called by the Employer will do so without loss of remuneration.
(a) At the request of the Union, the Employer will provide the Bargaining Unit with a current list of names, home addresses, work locations and job classifications.
(b) The Employer shall notify the Bargaining Unit in writing, by the 21st day of the following month, of all appointments, hirings, transfers, layoffs, recalls and terminations of employment, retirements and Leave of Absences exceeding one (1) month concerning Employees covered by this Agreement during the previous month.
(c) The Employer shall advise the Bargaining Unit of all vacancies and job postings.
9.08 The Union shall have the use of a Bulletin Board in each Board owned workplace for the purposes of posting notices relating to the Union’s business or Employee matters.

3.01 All employees at the date of signing this Collective Agreement who are covered by the Certification will be required to become and remain Union members as a condition of employment.

Union Security and Rights. A. Any employee who is not a member of the Union in good standing, or who does not make application for membership within thirty (30) days from the date of commencement of duties, or ratification of this contract, as a condition of employment must pay a non-member representative fee to the Union; provided however, that the employee may authorize payroll deduction for a non-member representative fee. The non-member representation fee shall be as established by the Union. In the event that an employee shall not pay such non-member representation fee directly to the Union, or authorize payment through payroll deduction, as provided in this Agreement, the Board shall, pursuant to MCLA 408.477; MSA 17.277(7) and at the request of the Union, deduct the non-member representation fee from the employee's wages and remit the same to the Union. That policy, and the administrative procedures (including the timetable for payment) pursuant thereto, applies only to non-union bargaining unit members. The remedies set forth in that Policy shall be exclusive, and unless and until such procedures, including any administrative or judicial review, thereof, shall have been availed of and exhausted, no dispute, claim or complaint by an objecting bargaining unit member concerning the application and interpretation of this Article shall be subject to the Grievance Procedure set forth in this Agreement, or any other administrative or judicial procedure. The Union shall provide to all non-members copies of the Union's Policy and Procedures.
B. An employee who shall tender or authorize the deduction of membership dues or non-member representative fees required as a condition of acquiring or obtaining membership in the Union, shall be deemed to meet the conditions of this Article so long as the employee is not more than sixty (60) calendar days in arrears of payment of such dues or fees.
C. The Board agrees that upon hiring any new employees who are covered by this Agreement, the Board shall send a letter advising the Union of the name and date of hire of the new employee.
D. In the event of any legal action against the Employer brought in a court or administrative agency because of its compliance with Section A of this Article, the Union agrees to defend such action, at its own expense and through its own counsel, provided...

Union Security and Rights a. The Town agrees to deduct Union dues, as established by the Union, from the pay of each member of the bargaining unit in equal amounts from each pay, as the frequency of pay periods may require, upon receipt from each such member of a written authorization. The amount of such deductions for Union Dues are to be transmitted to the duly elected Treasurer of the Union by the 8th day of each successive month.
b. All members of the bargaining unit who choose not to become members of the Union shall pay each month a lawful agency fee as a condition of continued employment. The Town shall deduct and transmit such fee in the same manner as provided for Union dues in paragraph (a), above. The Union agrees to indemnify the Town and hold it harmless for any and all claims and liabilities asserted against the Town and cost incurred by it which arise out of such payroll deductions.
c. The Union will notify the Town in writing not less than thirty (30) days prior to any change in the amount of Union dues or lawful agency fee.

Dues Checkoff While this Agreement is in effect, the Village will deduct from each employee's pay check once each pay period an amount no more than the appropriate portion of the regular monthly Union dues for each employee in the bargaining unit for whom there is on file with the Village a voluntary, effective checkoff authorization in the form set forth in Appendix A of this Agreement. The amounts so deducted shall be forwarded monthly by the Village within twenty (20) calendar days of the deduction, to the Union at the address designated by the Union, together with a list of names (and amounts) for whom deductions have been made. The actual amount deducted, as determined by the Union, shall be the same amount for each employee in order to ease the Employer's burden of administering this provision. If the employee has no earnings due for that pay period, or if the employee is on disability or receiving workers' compensation, the Union shall be responsible for collecting said dues. The Union agrees to refund to the employee any amount paid to the Union in error on account of this dues deduction provision. The Union may change the fixed, uniform dollar amount, which shall be considered the regular monthly dues once each year during the life of this Agreement.

All Employees noted as having joined the Union at the time of certification or who subsequently elected to join shall, as a condition of employment, remain members in good standing of the Union according to the constitution and by-laws of the Union. All Employees hired subsequent to the ratification of this Agreement shall, as a condition of employment, become and remain members in good standing of the Union as of the first day of employment.
