Common use of Use of Personal Leave Clause in Contracts

Use of Personal Leave. (a) A Full-Time or Part-Time Employee with responsibilities in relation to a class of person set out in clause 27.1(c)(ii), who needs the Employee’s care or support shall be entitled to use, in accordance with this clause 27.1, any current or accrued personal leave entitlement provided for at clause 26 Personal Leave, for absences to provide care or support for such persons when they are ill or injured, or who require care due to an unexpected emergency. Such leave may be taken for part of a single day. (b) The Employee shall, if required by the Employer, establish either by production of a medical certificate, statutory declaration by the Employee, written statement or other evidence that: (i) the person concerned is ill or injured and requires care; or (ii) the nature of the emergency and that such emergency resulted in the person concerned requiring the Employee’s care. (c) The entitlement to use personal leave in accordance with this clause 27.1 is subject to: (i) the Employee being responsible for the care or support of the person concerned; and (ii) the person concerned being: (A) a member of the Employee’s immediate family as defined in section 12 of the Act; or (B) a member of the Employee's household. (d) The Employee shall not be entitled to paid carer’s leave unless he or she notifies the Employer of the need for carer’s leave and the estimated period of absence at the first available opportunity and, where possible, before the first organised activity at the School on the day of absence. (e) Any carer’s leave taken in accordance with this clause shall be deducted from the personal leave entitlement of the Employee in accordance with clause 26 Personal Leave. A period of ▇▇▇▇▇’s leave shall be paid leave only to extent that the Employee has sufficient unused personal leave available.

Use of Personal Leave. Such leave may be taken for part of a single day. (b) The Employee shall, if required by the EmployerSchool, establish either by production of a medical certificate, statutory declaration by the Employee, written statement or other evidence that: (i) the person concerned is ill or injured and requires care; or (ii) the nature of the emergency and that such emergency resulted in the person concerned requiring the Employee’s 's care. (c) In normal circumstances, an Employee shall not take carer's leave under this clause 16.1 where another person has taken leave to care for a person referred to in clause 16.1(d)(ii). (d) The entitlement to use personal leave in accordance with this clause 27.1 16.1 is subject to: (i) the Employee being responsible for the care or support of the person concerned; and (ii) the person concerned being: (A) a member of the Employee’s 's 'immediate family family' as defined in section 12 of the Act; Act or (B) a member of the Employee's household. (de) The Employee shall not be entitled to paid carer’s 's leave unless he or she notifies the Employer School of the need for carer’s 's leave and the estimated period of absence at the first available opportunity and, where possible, before the first organised activity at the School on the day of absence. (ef) Any carer’s 's leave taken in accordance with this clause shall be deducted from the personal sick leave entitlement of the Employee in accordance with clause 26 15 Personal Leave. A period of ▇▇▇▇▇’s leave shall be paid leave only to extent that the Employee has sufficient unused personal leave available.
