User Communication. 14.1 USER understands and agrees that Calyx POS may include certain communications from CALYX, such as administrative messages, renewal and billing notices, Service announcements, and notifications of operational updates, bug-fixes, or other changes that may affect or change Calyx POS’s features offered by CALYX, and that CALYX reserves the right to send such communications via e-mail. Please note that USER cannot opt out of such e- mails because these e-mails provide information critical for the operation of USER’s Website.
14.2 USER HEREBY GRANTS CALYX EXPRESS WRITTEN PERMISSION TO E-MAIL SOLICITATIONS OR ADVERTISEMENTS, THUS SATISFYING ANY EXPRESS WRITTEN PERMISSION REQUIREMENT.
User Communication. Built and its affiliates may communicate directly with Users for the purposes of providing the Services and offering additional features and services, including without limitation inviting Users to receive applicable industry information, notifying Users of new and/or modified features, services and products, and offering Users training opportunities and materials related to Built’s Platform and services or products. Built may make additional products available to Participant Users within the Built Platform and provide Participants Users with integrated access to all products selected by the Participant User including the Services.

User Communication. (a) Notwithstanding anything to the contrary, the parties agree that users who exclusively use the Joby eVTOL Air Mobility Services via the Uber App are Uber Customers and, as between the parties, only Uber will communicate and market to those Uber Customers, except as reasonably necessary for Joby to provide customer support as specified in applicable SOWs, or as otherwise agreed by the parties in writing from time to time.
(b) Notwithstanding anything to the contrary, the parties agree that users who, in addition to downloading the Uber App Integration, have also downloaded the Joby App and set up an account (independent of any shadow account that may need to be created by Joby in order to enable Joby eVTOL Air Mobility Services via the Uber App) may also be considered Joby Customers and Section 4.4(a) does not apply to such Joby Customers.
