Vacancies and Assignments. A. Definitions
1. Vacancy - A position which is not filled due to a retirement, resignation, termination, transfer, successful job bid, or death, which the Board intends to fill, or a newly created position.
2. Job Bid - The process of requesting a change in assignment or classification through a response to a posted vacancy.
3. Newly Created Position - A new classification or an increase in the number of staff employed in an existing classification.

Vacancies and Assignments. 7.1 VACANCIES AND POSTINGS A vacancy will be defined as a permanent position which has been newly created, or which has previously existed and has been vacated due to transfer, promotion, reassignment, resignation, retirement, death or termination. The term “vacancy” will not apply to any position from which an employee is absent due to leave. Whenever a vacancy occurs within the bargaining unit and the District intends to fill the position, the Office of the Superintendent shall post a vacancy notice on the Triad website and email the Association President and a designee, and post a vacancy notice within each school building (during the school year and summer) for a minimum of 7 calendar days. (Exception: paraprofessionals hired to fill the requirements of 6th day enrollment or paraprofessionals or medical assistant required by IEP’s for new students). The Association will then accept the responsibility to see that the Association members are aware of the newest openings. In the event the District considers not filling a vacancy, the Association President will be notified in writing and the Association will have the opportunity to bargain the decision and impact to impasse. The District will not be required to post a vacancy that it determines not to fill following negotiations with the Association. Postings for all positions will state the date of posting, job description, qualifications needed, job classification, length of employment day, length of employment year, pay scale, and benefits. All qualified employees will be given an opportunity to make an application. No position will be filled until all properly submitted applications have been considered.
Vacancies and Assignments. 15.01 The Gallery shall post notice of permanent and temporary job vacancies for a period of seven (7) calendar days before any such job is permanently filled. Probationary employees shall not be entitled to apply for posted vacancies.
15.02 When a notice of permanent or temporary job vacancy is posted it shall contain the following information: nature of position; qualifications; skills and education required; proposed hours of work and wage or salary rate or range. It is understood that all positions are open equally to male and female applicants.
15.03 In filling a vacancy, seniority, qualification, skill, ability and physical capacity to perform the work shall be considered.
15.04 Nothing in this Article shall be construed as restricting the right of the Gallery to temporarily assign an employee to a job on a temporary basis until arrangements have been made to promote or transfer the employee selected to fill a vacancy.
15.05 A temporary transfer or assignment shall not exceed a period of sixty (60) calendar days unless such temporary transfer is made to fill a vacancy created by a leave of absence granted to an employee.
15.06 It is recognized that periods of temporary absence can be used to provide temporary training and experience to employees, which may assist them in applying for future job vacancies. The Gallery, therefore, shall endeavour to distribute such opportunity equitably among employees in order of seniority who are or have been employed in a similar or related job. It is understood, however, that the interest of the Gallery in maintaining an efficient operation and in effectively utilizing its employees is of primary importance in assigning employees to temporary vacancies.
15.07 In filling vacancies the Gallery may consider and select the senior applicant who does not possess the requisite qualifications to meet the job requirements but who is engaged in some special training in order to become qualified for such position, provided the employee will become qualified within a reasonable period of time.
15.08 The Gallery shall endeavour to post notice of permanent and temporary job vacancy at least five (5) days before a vacancy is to occur in normal circumstances and at least five (5) days after a vacancy has occurred in extraordinary circumstances.

Vacancies and Assignments. The District and Association strongly agree that all vacancies shall be filled with the best possible personnel available.
A. The District shall deliver to each unit member and post in each school building position announcements for all vacancies and new positions which occur during the school year. Each position announcement shall contain the following:
1. A closing date which is a least ten (10) working days following the posting date.
2. A job description.
3. Credentials and qualifications necessary to meet the requirements of each position.
B. By March 1st each year, the District will survey the unit members in order to plan for the subsequent school year. The survey shall ask each unit member about: plans to return planned leaves grade level, subject and configuration preferences whether or not they would like to be contacted during, the summer regarding vacancies
C. By March 15 of each year the District will distribute to each member, and post at each site, a list of tentative assignments, reassignments, and prospective vacancies for the following school year. The District shall attempt to fill prospective vacancies for the following school year in-house before advertising to the general public. Unit members may apply for transfer to the prospective vacancies by April 1st.
D. If no interest is shown by April 1st, or if all in-house teachers have been turned down after receiving full and fair consideration, then the position may be filled through involuntary transfer or by advertising to and hiring from the general public.
E. Except between March 15th and April 1st, the District may advertise vacancies to the general public and to in-house teachers; concurrently
F. All in-house applicants who have the necessary credentials and qualifications shall be granted an interview upon submitting an application for filling a vacancy, any time during the year.
G. When vacancies are announced after the last day of instruction the District shall mail and email a position announcement to each unit member's current mailing address and District email address on file with the District provided the teacher has specifically requested to be contacted during the summer. Teachers shall have ten (10) days to respond after receiving the position announcement.

5. A bargaining unit member awarded a new position may return to her/his original position during the posting period of his/her former position, to a maximum of thirty (30) days.
