WORDS AND EXPRESSIONS. In this Form of Agreement words and expressions have the same meanings as are respectively assigned to them in Section II of the CHARTERPARTY.

WORDS AND EXPRESSIONS. Words and expressions which are used in this Agreement, but which are not defined herein shall, unless the context otherwise requires, have the same meaning as assigned thereto in the Rules, Byelaws and Regulations of the Exchange and circulars issued there under.

WORDS AND EXPRESSIONS. In this Agreement, unless the context requires otherwise: (a) the singular includes the plural and vice versa; (b) words denoting any gender include all genders; (c) where a word or phrase is defined, its other grammatical forms have a corresponding meaning; (d) a reference to a party, clause, paragraph, schedule, or annexure is a reference to a party, clause or paragraph, schedule, or annexure to or of, this Agreement; (e) a reference to this Agreement includes any schedules or annexures to it; (f) headings are for convenience and do not affect interpretation; (g) the background or recitals to this Agreement are adopted as and for part of this Agreement; (h) a reference to any document or agreement includes a reference to that document or agreement as amended, novated, supplemented, varied or replaced from time to time; (i) a reference to “$”, “US$”, “USD” or “dollar” is a reference to the currency of the United States; (j) a reference to a party includes its executors, administrators, successors, substitutes (including persons taking by novation) and permitted assigns; (k) a reference to writing includes any method of representing words, figures or symbols in a permanent and visible form; (l) words and expressions denoting natural persons include bodies corporate, partnerships, associations, firms, governments and governmental authorities and agencies and vice versa; (m) a reference to any legislation or to any provision of any legislation includes (i) any modification or re-enactment of the legislation; (ii) any legislative provision substituted for, and all legislation statutory instruments and regulations, issued under the legislation or provision; and (iii) where relevant, corresponding legislation in any Australian State or Territory; (n) no rule of construction applies to the disadvantage of a party because that party was responsible for the preparation of this Agreement or any part of it; (o) the word “or” means “and/or” unless the context dictates otherwise because the subject of the conjunction are mutually exclusive; and (p) the words “including”, “for example”, “such as” or other similar expressions (in any form) are not words of limitation.

WORDS AND EXPRESSIONS used herein and not defined in the Act or Rules or Regulations, but defined in any other applicable law for the time being in force, shall have the meaning assigned to them respectively in those laws.

WORDS AND EXPRESSIONS. In this Deed the following expressions shall have the following meanings unless inconsistent with the text: means the Town and Country Planning Act 1990 as amended;

WORDS AND EXPRESSIONS. “Appeal” the appeal against the refusal of the application with reference 22/03045/VAR made by LCA on 26 July 2023 and given reference APP/G5750/W/23/3326646 “Appeal Decision” means the final decision by the Secretaries of State which determines the Appeal and grants the s73 Permission
