WORK SCHEDULE AND OVERTIME. 9.1 Firefighters at all stations will be assigned to work a rotation of two 10 hour day shifts, followed by two 14 hours night shifts, followed by four days off, for an average of 42 hours per week. In addition, some employees may be assigned to a 10 hour day shift with consideration being given to senior members to remain on the day/night rotation. This may include assigning new firefighters to straight day schedules, with the flexibility to move these firefighters to fill shortages in the schedule. Shift starting and stopping times, or rotation changes, shall be implemented only after advance notice and discussion with the Union and employees involved. In the event of operational changes, equipment changes or new or different station locations, schedule changes will only be implemented after discussion with the Union and at least 30 calendar days notice, but average weekly work hours will not exceed 42 without prior agreement. 9.2 Employees shall be entitled to overtime pay at their regular rate for hours worked in excess of normally scheduled shift assignments, but shall receive time and one-half for any hours exceeding 192 in a 28 day period. The 28 day period shall coincide with the established pay periods, except that employees assigned to a straight day shift rotation shall be entitled to time and one-half for hours exceeding 48 in a seven day period. In the event of a recall to duty, or for District required appearances in court or before an agency, the employee shall receive two hours minimum pay. No additional pay shall be provided for less than 15 minutes of time worked before or after a regular shift, and the minimum pay for such additional time shall be 1/2 hour's pay. 9.3 Additional work made available to employees shall be distributed on an equitable basis and balanced, to the extent possible, during the year, taking into account the skills and abilities required for the additional work. The Assistant Chief will maintain and make available to the Union a rotation list evidencing these assignments. An employee offered and refusing additional work will be considered to have taken such work for purposes of the equitable distribution. 9.4 Unit members who work hours in excess of their regularly scheduled hours during a 2 week pay period may elect to receive contractual compensatory time off in lieu of wages for the additional hours worked. The compensatory time off will be awarded at the rate of one hour of compensatory time off for each hour of additional work. No unit member will be allowed to accrue more than 48 hours of compensatory time off and all accrued but unused hours of compensatory time off will be cashed out at a straight time rate at the end of each calendar year. No unit member may elect to receive contractual compensatory time off for any hours worked in excess of 192 in a 28 day period. A. Unit members electing to receive contractual compensatory time off in accordance with the above paragraph must provide notice of that election to the Assistant Chief or other individual designated by the District either electronically using the District’s payroll or scheduling software, or by submitting a completed request form, which will be developed by the District. Such notice must be provided by the employee in a timely manner so as not to impede or impact the District’s ability to process payroll. Failure to provide the required notice will result in the time being compensated regularly in wages. B. Unit members wishing to take compensatory time off must submit a written request to the Assistant Chief or other individual designated by the District at least 48 hours prior to the requested time off. Requests for compensatory time off will be granted unless there are personnel shortages. The requirement to provide at least 48 hours notice may be waived by the Assistant Chief or other individual designated by the District.

WORK SCHEDULE AND OVERTIME. 9.1 Firefighters at all stations 8.1 The work schedule for employees shall be as follows:
A. The full-time workweek shall consist of thirty seven and one-half (37.5) hours. Paid leave time shall count as part of the workweek.
B. The workday shall consist of seven and one-half (7.5) hours, not including lunchtime, except as provided in 8.1.C below. The College shall be free to establish a work schedule for employees as is necessary for the operation of the College. The Association acknowledges that certain employees will be assigned required to work shifts starting earlier than 8:00 a.m. and some shifts continuing after 4:30 p.m., as determined by the College.
C. Should the College adopt a rotation of two 10 flexible hour day shiftsworkweek, followed by two 14 total straight time weekly hours night shiftsshall not exceed thirty seven (37.5).
8.2 Overtime work, followed by four days off, for an average of 42 hours per week. 9.2 Employees A. For any employee, overtime shall be entitled to overtime pay at their regular rate paid for all hours worked in excess of normally forty (40) per week.
B. Full-time employees shall be paid overtime for work on Saturday and/or Sunday if hours worked for the week are in excess of 40 hours, unless part of the regular workweek.
C. Part-time employees shall be paid overtime for the sixth (6th) and seventh (7th) day of work in a workweek.
D. Holidays and vacation days other than the day on which overtime occurs, shall count as time worked for purposes of overtime computation. Personal and paid leave days will only count towards overtime computation when the scheduling of said hours is mandatory.
8.3 Double time will be paid for all hours worked on holidays.
8.4 All employees, called in to work on short notice of twelve (12) hours or less, shall be paid for a minimum of two (2) hours, payable at their regular rate of pay unless they are in an overtime situation or it is a holiday, in which case, they shall receive the overtime or holiday pay, whichever is appropriate.
8.5 In any instance where weather or other acts of God cause the closing of the College, employees not required to report shall suffer no loss of pay or benefits. Campus patrol personnel, if scheduled shift assignmentsfor assigned duty or called in to work on a day the College is closed due to weather or other acts of God, but shall receive time and one-one half for any all hours exceeding 192 in worked on said days.
8.6 All employees working five (5) or more hours a 28 day period. The 28 day period shall coincide with the established pay periods, except that employees assigned to a straight day shift rotation shall be entitled to an unpaid, duty- free, uninterrupted lunch period of sixty (60) minutes.
8.7 All employees shall be provided relief time of fifteen (15) minutes away from their workstation in the morning and in the afternoon. Part-time employees working less than two and one half (2 1/2) hours in the morning, or two and one-half for (2 1/2) hours exceeding 48 in the afternoon, are excluded from this provision. Campus patrol personnel shall remain available on campus during their relief time.
8.8 Overtime shall be divided among employees within each department:
A. No employee will be required to work over forty-four (44) hours in any one (1) week.
B. Overtime usage information will be maintained by each department supervisor. Overtime will be offered to each employee on a seven day periodrotation based on seniority within the department. Overtime that is refused by an employee will be recorded.
C. In the event that overtime is not distributed properly the remedy shall be that a member who has missed an opportunity for overtime will be given the chance to work the next available overtime hours until the member has been made whole in terms of time lost or has refused the equivalent number of hours.
8.9 If non-probationary employees are not required to report for duty during the interval between Christmas Day and New Year’s Day, they shall not suffer any loss of pay or benefits.
8.10 Campus Patrol personnel shall be scheduled on a recall monthly basis at the discretion of the College. Schedules shall be available by the 15th of the preceding month. Such schedules shall be posted in the Campus Patrol office. Schedules may be changed prior to dutytwo (2) weeks of the affected work date at the discretion of the College; within two (2) weeks of the affected work date, or for District required appearances in court or before an agency, schedules may be changed only with the mutual agreement of the employee shall receive two hours minimum pay. No additional pay shall and the immediate supervisor.
8.11 Employees may be provided for less than 15 minutes allowed a reasonable amount of time worked before or after a regular shift, and the minimum pay to be used for such additional time shall be 1/2 hour's pay.
9.3 Additional work made available to employees shall be distributed on an equitable basis and balanced, to the extent possible, during the year, taking into account the skills and abilities required for the additional work. No unit member may elect to receive contractual compensatory time off for any hours worked in excess of 192 in a 28 day period.
A. Unit members electing to receive contractual compensatory time off in accordance with the above paragraph must provide notice of that election to the Assistant Chief or other individual designated by the District either electronically using the District’s payroll or scheduling software, or by submitting a completed request form, which will be developed by the District. Such notice must be provided College committees/activities as mutually agreed upon by the employee in a timely manner so as not to impede or impact the District’s ability to process payroll. Failure to provide the required notice will result in the time being compensated regularly in wagesand supervisor.
B. Unit members wishing to take compensatory time off must submit a written request to the Assistant Chief or other individual designated by the District at least 48 hours prior to the requested time off.
