The 'Working on Public Holidays' clause defines the rules and conditions under which employees may be required to work during officially recognized public holidays. Typically, this clause outlines whether work on such days is mandatory or voluntary, the process for assigning shifts, and the additional compensation or time off that employees are entitled to if they work on a public holiday. Its core function is to ensure fairness and legal compliance in managing work schedules during public holidays, while also clarifying employee rights and employer obligations to prevent misunderstandings or disputes.
Working on Public Holidays. The Employee agrees to work on any public holiday that would otherwise be a working day for them, if required. The Employee also agrees not to work on any public holiday unless asked to do so. If the Employee works on a public holiday, they will be paid their relevant pay for the time actually worked at the rate of time-and-a-half. They will also be entitled to time off in lieu equivalent to the hours worked. If the Employee does not work on a public holiday, they will receive a paid day off if a public holiday falls on a day that would otherwise be a working day for them. If the Employee is on sick leave or bereavement leave on a public holiday on which the Employee was scheduled to work, then the day will be treated as an unworked public holiday. The Employee will receive a paid day off but will not be entitled to time and a half or an alternative holiday.
Working on Public Holidays. From time to time there may be a requirement to request certain areas of the business to work on a Public Holiday. If such a request is made, employees may be offered the choice of receiving double time and a half payments for time worked, or they may decide to receive time and a half payment plus a day off in lieu of the Public Holiday worked. This offer would be discussed with those involved in advance of the Public Holiday so that pay arrangements for any such situation are clear and agreed. This option is not an automatic choice and may not be offered to production employees.
Working on Public Holidays. If the Employee works on a public holiday, they will be paid their relevant pay for the time actually worked at the rate of time-and-a-half.
Working on Public Holidays. The employer may require adequate staffing on weekends and gazetted public holidays specific to a particular state and public holidays that do not apply to all states in Australia on the same day. This clause does not diminish in any way the employer’s right to require employees to work reasonable overtime to cover staffing requirements for weekends and/or public holidays.
Working on Public Holidays. 20.2.1 Where an employee is required to work on a public holiday they will be paid for all time worked at the rate of double time and one half.
20.2.2 By agreement between the employer and the Officer concerned, the Officer may be granted time off in ordinary hours equivalent to the penalty rate, without loss of pay at a mutually agreed time.
20.2.3 If an employee is not rostered to work on a public holiday, but is recalled to work on that day the employee is entitled to be paid a minimum of 3 hours work at the appropriate rate. Time reasonably spent travelling to and from work shall be counted as work time.
20.2.4 On any public holiday not prescribed as a holiday under this agreement, the employer’s establishment or place of business is closed, in which case an employee need not present themselves for duty and payment may be deducted, but if work is done, ordinary rates shall apply.
Working on Public Holidays. (i) If an employee is required to work in accordance with the provisions of this Collective Agreement on any part of a public holiday, they shall receive payment for the greater of -
(a) the portion of the employee’s relevant daily pay (less any penal rates) that relates to the time actually worked on the day plus half that amount again; or
(b) the portion of the employee’s relevant daily pay that relates to the time actually worked on the day.
(ii) In sub-clause (i) (a) above ‘penal rates’ -
(a) means an identifiable additional amount that is payable to compensate the employee for working on a particular day of the week or a public holiday; but
(b) does not include, for example, any additional payment for a sixth or seventh day of work.
Working on Public Holidays. All time worked on the public holidays set out in clause 6.6 (Public Holidays) outside the ordinary working hours specified in this Agreement, prescribed by a roster, or usually worked on the day of the week on which the holiday is kept, shall be paid at double the rate prescribed by this Agreement for such time when worked outside such working hours on an ordinary working day. That is, where the rate prescribed is time and a half the rate payable is three (3) times the ordinary rate and where the rate prescribed is double time the rate payable is four (4) times the ordinary rate.
Working on Public Holidays. The growing of chickens is dependent on natural cycles related to the laying and hatching of chicks, and as a consequence, employees will be required to work on all public holidays.
Working on Public Holidays. All time worked on any of the aforesaid holidays outside the employee's ordinary starting and ceasing times for the Day of the week on which such holiday falls will be paid for at the rate prescribed for such Public ▇▇▇▇▇▇▇▇ as prescribed in clause 3.1
Working on Public Holidays. (a) Except in the situation specified above, where some Employees are required to work on a public holiday such Employees will be paid double time and one half for each hour worked on a public holiday.
(b) When Employees are required to work on a public holiday the Employer will select Employees on the following basis:
(i) The Employer will call for volunteers.
(ii) The principle of equal access to work on public holidays will apply for Employees who volunteer to work on a public holiday.
(iii) When the number of volunteers exceed the Employer requirements, the volunteers who are not able to be allocated work shall be given preference for public holiday work when they volunteer on future occasions.
(iv) The Employer will maintain a record of volunteers for the purpose of ensuring the principle of equal access for those Employees who volunteer to work on public holidays.
(c) Casual Employee/s who are required to work on a public holiday shall be paid at the relevant public holiday rate plus the ordinary casual loading, not compounding.
