Any refusal by the employee to work in contravention of such regulations or without adequate rest (up to eight (8) hours of any twenty-four (24) hour period) shall not be deemed to be a breach of this Agreement and shall not be a reason for discharge. 6.5 After due warning any refusal by an employee to abide by any applicable accident prevention regulation of any governmental or appropriate regulatory body having jurisdiction, shall be cause for discharge. 6.6 The Job ▇▇▇▇▇▇▇ shall represent the Union as a member of any Job Safety Committee and he, or another committee member representing one of the Unions, depending upon the nature of the inspection, shall be made freely available by the Employer to accompany any authorized governmental representative on project inspection. 6.7 The certified health and safety representative, where required by legislation, will not be excluded from overtime work, by crew or project, provided he is able to perform the work required and shall be one of the last three employees retained by the Employer if competent to perform the available work remaining. 6.8 A Job Safety Committee meeting shall be held within two weeks after the commencement of the job and thereafter at least once each month. A copy of the Minutes shall be forwarded promptly to the Local Union. 6.9 Employees will be permitted a fifteen minute work break for each half shift worked during working hours provided that this will be done in such a manner as will least interfere with the continuous performance of the work. 6.10 Where the nature and location of the work, as determined at the Pre-job Conference, are such as to require special clothing for protection from adverse weather elements and such clothing is not normally in the possession of the employee, the Employer shall provide or, at his option, reimburse the cost of such clothing. 6.11 The Employer shall provide iced drinking water in approved sanitary containers and paper cups where no running tap water is available. 6.12 The Employer will provide parking at the warehouse and/or marshalling point. During cold weather operation the Employer will provide for vehicle starting. 6.13 The Employer shall provide portable sanitary facilities for all employees where necessary. 6.14 Cell phones will not be used for personal purposes during the work day, and any electronic equipment such as audio or video players that utilize head phones, ear phones, ear buds, remote ear or head sets (such as BlueTooth-type) or similar equipment will not be used during the workday, except during lunch and break periods provided for in Article 6.9.

If the UNION can not provide the required manpower, the EMPLOYER can bring in the required work Force from another jurisdiction. If during the course of the project, manpower does become available to the UNION, the EMPLOYER will not be required to lay off or send back any other employeeof his EMPLOYEES brought in without prior Approval of the EMPLOYER, EMPLOYEE or the UNION. Mandatory replacement will not be required. 6.3 The Employer 2. The EMPLOYER will make available, a warm dry place for EMPLOYEES to eat lunch, standby and store tools during work hours on each job site with a minimum crew of seven (7) journeymen bricklayers. 8. EMPLOYEES are not expected to carry power tools, equipment or materials for a project, to or from the job site with their personal vehicles unless previously arranged with the Employer. 9. Apprentices will not be used as cheap Hodcarrier's nor will they be hired as full time ▇▇▇▇▇▇▇. An Apprentice who feels the EMPLOYER has violated Article IX; Section 3 above, will report the matter to the Apprentice Coordinator or Union representative and, if available, the craft ▇▇▇▇▇▇▇, who shall attempt to resolve the problem with the ▇▇▇▇▇▇▇, Employer or any other person delegated as the Employer's agent. 10. The Employer shall provide furnish all tools necessary to make a copy complete plumbing, heating, piping, refrigeration, or air conditioning installation, which shall include welder’s hoods, gloves, sleeves, hard hats, rubber boots, rain gear, safety goggles, dust masks and safety belts which shall be kept in a sanitary condition. All employees shall be familiar with and comply with safety requirements as specified by OSHA. Hand tools furnished to employees by the Employer become the responsibility of the "Approved Safety Manual employees who shall be permitted to transport tools up to and including a 14-inch wrench in their personal vehicles for Pipeline Construction safekeeping purposes. The employees agree to sign an itemized listing of all hand tools furnished and Section 4. During working hours, no vehicle of any description which is not furnished by Employer shall be used by any employee in Canada" issued the performance of his work. Section 5. Each Employer will carry Workers' Compensation Insurance and Unemployment Compensation Insurance on employees covered by this Agreement in accordance with Texas statutes governing such insurance, whether required by such statues or not. Section 6. Any unloading, handling, rigging, transfer and/or distribution of materials necessary for work covered by this agreement and the supervision of same shall be performed by employees covered by this agreement, except that others may make the first drop of materials at the job site at ground level in a storage area designated by the Association Employer. There shall be one drop site per building except where mechanical means are utilized to unload. Such work shall be subject to any award of the Job National Joint Board for Settlement of Jurisdictional Disputes. Section 7. Sanitary drinking cups, or sanitary fountains and ice water, rest rooms, and provision for washing hands and face must be available for all employees at the jobsite. Section 8. The Union may designate one journeyman per jobsite as a ▇▇▇▇▇▇▇. The Employer shall provide a copy of the "Approved Safety Manual for Pipeline Construction in Canada" issued by the Association to the Job ▇▇▇▇▇▇▇ and, upon request, to any other employee. 6.3 . The Employer shall provide rain suits and rubber bootssuits, when required, and safety hats at no cost to the employee provided the employee returns same on termination of employment. 6.4 . The parties hereto shall comply with any governmental occupational health and safety regulations applicable to the work. Any refusal by the employee to work in contravention of such regulations or without adequate rest (up to eight (8) hours of any twenty-four (24) hour period) shall not be deemed to be a breach of this Agreement and shall not be a reason for discharge. 6.5 . After due warning any refusal by an employee to abide by any applicable accident prevention regulation of any governmental or appropriate regulatory body having jurisdiction, shall be cause for discharge. 6.6 . The Job ▇▇▇▇▇▇▇ shall represent the Union as a member of any Job Safety Committee and he, or another committee member representing one of the Unions, depending upon the nature of the inspection, shall be made freely available by the Employer to accompany any authorized governmental representative on project inspection. 6.7 . The certified health and safety representative, . where required by legislation, will not be excluded from overtime work, by crew or project, provided he is able to perform the work required and shall be one of the last three employees retained by the Employer if competent to perform the available work remaining. 6.8 A Job Safety Committee meeting shall be held within two weeks after the commencement of the job and thereafter at least once each month. A copy of the Minutes shall be forwarded promptly to the Local Union. 6.9 Employees will be permitted a fifteen minute work break for each half shift worked during working hours provided that this will be done in such a manner as will least interfere with the continuous performance of the work. 6.10 . Where the nature and location of the work, as determined at the Pre-job Conference, are such as to require special clothing for protection from adverse weather elements and such clothing is not normally in the possession of the employee, the Employer shall provide or, at his option, reimburse the cost of such clothing. 6.11 . The Employer shall provide iced drinking water in approved sanitary containers and paper cups where no running tap water is available. 6.12 . The Employer will provide parking at the warehouse and/or marshalling point. During cold weather operation the Employer will provide for vehicle starting. 6.13 . The Employer shall provide portable sanitary facilities for all employees where necessary. 6.14 Cell phones will not be used for personal purposes during the work day, and any electronic equipment such as audio or video players that utilize head phones, ear phones, ear buds, remote ear or head sets (such as BlueTooth-type) or similar equipment will not be used during the workday, except during lunch and break periods provided for in Article 6.9.

In the event of a lay-off or discharged their payment(s) discharge, employees cheques for wages all earnings due them at the time of lay-off or discharge must be made by electronic transfer or mailed, and the Record of Employment must be mailed, to the employee’s last known address delivered as soon as possible, but no later than the Employer’s next regular payday.
