WORKING RULES. The Employer shall be the sole judge as to the number of employees required. It is recognized that the work of handling clamps, lining up of pipe and the making of joints is the work of the Union. In addition to the Welder ▇▇▇▇▇▇▇, the Welders and their Helpers, the Employer shall be required to employ a minimum of five (5) Journeymen on jobs where pipe is greater than 14" in diameter, four (4) of whom shall be used in the pipe gang, and the fifth Journeyman to be used either in the pipe gang, bevelling ahead of the pipe gang, in the bending crew, in the tie-in crew, in stress relieving, or in preheating with oxy-acetylene torches; on pipe 14" in diameter or less the Employer shall be required to employ two Journeymen other than the Welder ▇▇▇▇▇▇▇, the Welders, and their Helpers; provided however, that in the event an inside clamp is being used on pipe 14"in diameter and less, the Employer shall also be required to employ one (1) Graded Helper. If outside clamps are used, a Welder Helper shall be assigned to handle such clamps. On pipelines of 14" in diameter or less, the operation of the bending mandrel and the handling of clamps shall be performed by a Graded Helper. On pipelines of greater than 14" in diameter the handling of clamps and the operation of bending mandrels shall be performed by, Journeymen. If any additional employees are needed, they shall be employed as Journeymen or Helpers depending on what work is involved. On small jobs when less than five (5) Welders are employed, the Welder ▇▇▇▇▇▇▇ will be allowed to work with the tools, at the discretion of the Employer. At the beginning and end of larger jobs where more than five (5) Welders will be or have been employed, at any given time, the Welder ▇▇▇▇▇▇▇ will be allowed to work with the tools where it is not a full-time work day task. These provisions may be modified at the Conference. There shall be no inequitable minimum or maximum amount of work which an employee may be required to perform during the day and there shall be no restrictions imposed against the use of any type of machinery, tools, or labour saving devices. As mutually agreed between the Employer and the Local Union, employees may be changed from one classification to another within the jurisdiction of the Union. During emergencies, any employee of the Employer may be assigned to any work, provided, however, that no employee's hourly rate shall be lowered under this provision, and provided further that in the event an employee is assigned to work calling for a higher rate of pay he shall receive such higher rate. ▇▇▇▇▇▇▇▇ bead and hot-pass welders and helpers can be required to weld back on incompleted welds, as long as their wage rate is not lowered. Such welders and helpers will be paid for the hours received by the pipe gang plus the hours engaged in welding back and there shall be no restriction as to the location where such "weldingback" may begin. In the event back welding of each weld is performed inside the pipe as a regular procedure, one welder will be selected each day to perform all of such back welding. This condition is not intended to apply to occasional back welding performed by the pipe gang to repair a bead, to rectify a “hi-lo’’condition or wall thickness change, etc. The regular payday shall be not later than Thursday of each week, unless the Employer agrees to allow employees to draw on money earned; under such conditions, pay day may be once every two weeks. Insofar as job conditions permit, employees shall receive their pay cheques during their regular shift and in any event not later than within twenty (20) minutes of their return to the warehouse following said shift. When employees are laid off or discharged their cheques for wages due at the time of lay-off or discharge must be delivered on the same date. If the cheques due to the employee at time of lay-off or discharge are not delivered on the date of lay-off or discharge, the employee shall be entitled to waiting time or reporting time, subsistence allowance, or camp privileges, where applicable, for each day up to and including the date upon which the cheques are delivered. The Employer and the Local Union may agree at the Conference that, on jobs with less than one hundred (100) employees, if the Employer is unable to deliver the employee’s cheque for wages due at the time of lay-off or discharge, the employee will not be eligible for further waiting or reporting time, subsistence allowance, or camp privileges, however, this final cheque must be mailed to the employee’s home address within two

WORKING RULES. The Employer Section 1. Hod Carriers and Plasterer Tenders Clause - Whenever the plastering hose is not being used to apply plaster directly to the walls or ceiling, it shall be the sole judge as to the number of employees required. It is recognized that the work of handling clamps, lining up of pipe and the making of joints is the work of the UnionLaborers. Section 2. In addition to Pump man and/or mixer man shall stay at the Welder mixer or pump whenever plasters are working. Section 3. When two or more cement finishers are working, they shall have at least one (1) Laborer as a helper or as many more as the job may require, until all Laborers' work is completed. Laborers will not stay for the final troweling, unless ▇▇▇▇▇▇▇, the Welders and their Helpers, the Employer shall ▇' work is contemplated. 1) Lab Section 4. If outside clamps are a paving breaker or jackhammer is used, a Welder Helper two (2) men will be used to operate same, if hammer weight is fifty (50) pounds or more when used horizontally or eighty (80) pounds or more used vertically. The second man will clean u erating hammer. The employees used for this work shall use safety glasses at all times, and if necessary, use respirators. Section 7. It is agreed that when extra help is needed on the mixer and pump, it will be assigned to handle such clamps. On pipelines of 14" in diameter or lessdecided between the mixer man, the operation of the bending mandrel and the handling of clamps shall be performed by a Graded Helper. On pipelines of greater than 14" in diameter the handling of clamps and the operation of bending mandrels shall be performed by, Journeymen. If any additional employees are needed, they shall be employed as Journeymen or Helpers depending on what work is involved. Employees shall have the right to refuse to work with out of their own jurisdiction without cause for discharge. Section 9. Laborers shall not be required to furnish their own transportation when changing jobs for the toolsEmployer during the workday. Section 10. The Contractor shall furnish all tools overshoes, at hip boots if job requires, rainpants, raincoats, goggles, safety hats, new liners for said hats, rubber gloves for all composition mixes and all Section 11. It is understood that the discretion of Employer shall furnish gloves to the Employer. At the beginning and end of larger jobs where more than five (5) Welders will be or have been employed, at any given time, the Welder ▇▇▇▇▇▇▇ tenders or any employee handling bricks, block or tile. Section 12. Cement car men are to receive the same number of hours of employment per day as the other Laborers on the job. Section 13. First aid kits shall be furnished and maintained on all jobs. Section 14. If an employee wishes to take a vacation, he shall notify his Employer two (2) weeks in advance. This vacation shall not jeopardize his employment, if work is available upon his return. Section 15. There will be an overhead shelter furnished for the mixer machine at all times during inclement weather. Section 16. A warm clean shed shall be furnished for the employees to eat and change their clothes nd is not to be in. This shed is for the purpose designated a used for storage or a work shop. Section 17. All work of the Employer shall be performed under mutually provided safety conditions which must conform to State and Federal regulations. It shall also be a requirement of the employee to conform to safety regulations and measures as provided. If the employee refused to comply with safety regulations after a warning in writing, he may be discharged. Laborers will not be required to work in the rain unless in case of extreme emergency. Section 18. No Laborer shall leave the tool shed before his regular starting time, and shall have all tools put away by his regular quitting time, unless instructed to work overtime. Section 19. The Employer shall also furnish drinking water, fresh daily or more often as required, in clean, suitable container from a state approved water supply. The containers shall be cleaned with a proper cleaning agent whenever necessary. Clean ice shall also be furnished by the Employer for all drinking water. The drinking water shall be on the job in readily accessible places by thirty (30) minutes after starting time, and ice shall be available no later then thirty (30) minutes after starting time. Sanitary paper cups shall be placed with each water container. Section 20. When an employee works at the semi-skilled or skilled rate before 12 noon he shall be paid at the applicable rate until the lunch hour. If an employee works after 12 noon at the semi-skilled rate, he shall be paid at the applicable rate until quitting time. Section 21. Laborers who are required to work over ten (10) hours on job sites covered by this Agreement shall be provided with lunch, without cost to employee, and allowed to eat same without loss of time. Section 22. Refreshments brought to the designated work with area when work commences may be Section 23. Any work not covered by this Agreement or classification which comes under the tools jurisdiction of the Laborers shall be negotiated between the two (2) interested parties. Section 24. When employees are employed on a job on the day overtime is worked, or have worked on said job the preceding day, employees required for overtime work shall be selected from the crew working on said job. These provisions may be modified or the equivalent of eight (8) hours pay at the Conferencehis regular rate. Section 27. WORKING RULES. Section 1. There shall be no limitation to the amount of work an employee may perform during his working day. No employee will be permitted to sub-contract or do piece work. Section 2. There shall be no restriction on the use of machinery or tools used in connection with the installation of work, provided that if power cutting and threading machines are used on the job or in the shop they shall be operated by journeymen and/or apprentices There shall be no restrictions on the use of any raw or manufactured materials except prison- made. Any lead to be used will have to be wiped by shop using same; however, lead can be purchased from shop displaying Local 142 label, manufactured under the local collective bargaining agreement. Section 3. The Employer shall furnish all tools necessary to make a complete plumbing, heating, piping, refrigeration, or air conditioning installation, which shall include welder’s hoods, gloves, sleeves, hard hats, rubber boots, rain gear, safety goggles, dust masks and safety belts which shall be kept in a sanitary condition. All employees shall be familiar with and comply with safety requirements as specified by OSHA. Hand tools furnished to employees by the sole judge as Employer become the responsibility of the employees who shall be permitted to transport tools up to and including a 14 inch wrench in their personal vehicles for safekeeping purposes. The employees agree to sign an itemized listing of all hand tools furnished and further agree to pay for all hand tools lost or not accounted for. Responsibility for the number replacement of tools, which are broken or worn out, remains with the Employer. Any differences arising regarding hand tools Section 4. During working hours, no vehicle of any description which is not furnished by Employer shall be used by any employee in the performance of his work. Section 5. Each Employer will carry Workers' Compensation Insurance and Unemployment Compensation Insurance on employees requiredcovered by this Agreement in accordance with Texas statutes governing such insurance, whether required by such statues or not. Section 6. It is recognized that the Any unloading, handling, rigging, transfer and/or distribution of materials necessary for work of handling clamps, lining up of pipe covered by this agreement and the making supervision of joints is same shall be performed by employees covered by this agreement, except that others may make the first drop of materials at the job site at ground level in a storage area designated by the Employer. WORKING RULES. Section 1. The Employer shall have the right to assign his/her employees, on the job, to any particular work or classification of work and use his/her own judgment in this selection, provided the proper rate of pay is maintained. Gloves shall be issued when an employee commences employment and for replacement, old gloves must be returned or the Employee will be charged the replacement cost. (a) All tools and equipment shall be furnished by the Employer. Employees shall take every reasonable precaution to prevent loss or damage to tools and equipment furnished by the Employer and failure to do so will be deemed sufficient cause for discharge. (b) When an Employee is unable laid off or terminated, they shall be provided a reasonable amount of time in which to deliver pack up and return company tools. 13.07 Notwithstanding any portion of the employee’s cheque Agreement to the contrary, the Employer reserves the right to employ persons possessing special skills or equipment needed in the fabrication or manufacturing of anything produced in the shop or in the maintenance of the shop building or any of the equipment therein. It is understood this privilege will be used only when necessary and only when such special skills or equipment are not normally possessed by the members of the Union. In the event the above skilled individuals are required by the Employer, mutual agreement shall be reached by both parties prior to the work commencing. 13.08 Adequate parking shall be provided for wages due all Employees covered by this Agreement. If a paving breaker or jackhammer is used, two (2) men will be used to operate same, if hammer weight is fifty (50) pounds or more when used horizontally, or eighty (80) pounds or more when used vertically. The second man will clean up when not operating hammer. The employees used for this work shall use safety glasses and ear plugs at all times, and if necessary, use respirators. Section 18. No laborer shall leave the tool shed before the established starting time of lay-off or discharge and shall have all tools put away by the established quitting time, unless instructed to work overtime. In addition to the Welder ▇▇▇▇▇▇▇, the Welders and their Helpers, the Employer shall be required furnish gloves to employ a minimum of five (5) Journeymen on jobs where pipe is greater than 14" in diameter, four (4) of whom shall be used in the pipe gang, and the fifth Journeyman to be used either in the pipe gang, bevelling ahead of the pipe gang, in the bending crew, in the tie-in crew, in stress relieving, or in preheating with oxy-acetylene torches; on pipe 14" in diameter or less the Employer shall be required to employ two Journeymen other than the Welder ▇▇▇▇▇▇▇, the Welders, and their Helpers; provided however, that in the event an inside clamp is being used on pipe 14"in diameter and less, the Employer shall also be required to employ one (1) Graded Helper. If outside clamps are used, a Welder Helper shall be assigned to handle such clamps. On pipelines of 14" in diameter or less, the operation of the bending mandrel and the handling of clamps shall be performed by a Graded Helper. On pipelines of greater than 14" in diameter the handling of clamps and the operation of bending mandrels shall be performed by, Journeymen. If any additional employees are needed, they shall be employed as Journeymen or Helpers depending on what work is involved. On small jobs when less than five (5) Welders are employed, the Welder ▇▇▇▇▇▇▇ tenders or any employee handling bricks, blocks or tile. Section 5. Cement car men are to receive the same number of hours of employment per day as the other laborers on the job. Section 6. First aid kits shall be furnished and maintained on all jobs. Section 7. If an employee wishes to take a vacation, he shall notify his employer two (2) weeks in advance. This vacation shall not jeopardize his employment, if work is available upon his return. Section 8. There will be an overhead shelter furnished for the mixer machine at all times during inclement weather. Section 9. A warm clean shed shall be furnished for the employees to eat and change their clothes in. This shed is for the purpose designated and is not to be used for storage or a work shop. Section 10. The contractor shall furnish ice water in sanitary containers with sanitary drinking cups, or provide drinking water through sanitary drinking fountains. The water shall be available on the job at starting time and ice shall be available one (1) hour after starting time. A Laborer shall maintain all water containers and ice. Section 11. Refreshments brought to the designated work area when work commences may be consumed at the employee's designated work area providing same does not interfere with his normal productivity and/or efficiency. Section 12. When employees are employed on a job on the day overtime is worked, or have worked on said job the preceding day, employees required for overtime work shall be selected from the crew working on said job. Section 13. On any project or job where a central reporting place is designated the Employer must provide adequate means of transportation from said place to job site providing the designated reporting place is one-half (½) of a mile or more from the point where the employees are to work. Vehicles shall be properly covered during cold and inclement weather. Section 14. If laborers' work is being performed when cement finishers are working, they shall have one (1) laborer as a helper or as many as the job may require, until all laborers' work is completed. Laborers will not stay for the final troweling, unless laborers' work is contemplated. Section 15. There will be one (1) laborer, or more if the job requires, to tend sawmen, clean up, get new lumber, etc. Section 16. There will be one (1) laborer, or more if the job requires, to tend sandblasting. Section 17. If a paving breaker or jackhammer is used, two (2) men will be used to operate same, if hammer weight is fifty (50) pounds or more when used horizontally, or eighty (80) pounds or more when used vertically. The second man will clean up when not operating hammer. The employees used for this work shall use safety glasses and ear plugs at all times, and if necessary, use respirators. Section 18. No laborer shall leave the tool shed before the established starting time and shall have all tools put away by the established quitting time, unless instructed to work overtime. Section 19. Laborers who are required to work after ten (10) hours on job sites covered by this Agreement, shall be provided with lunch, without cost to employee, and allowed to work with eat same without loss of time. This condition is not intended to apply to occasional back welding performed by the pipe gang to repair a bead, to rectify a “hi-lo’’condition or wall thickness change, etc. The regular payday shall be not later than Thursday of each week, unless the Employer agrees to allow employees to draw on money earned; under such conditions, pay day may be once every two weeks. Insofar as job conditions permit, employees shall receive their pay cheques during their regular shift and in any event not later than within twenty (20) minutes of their return to the warehouse following said shift. When employees are laid off or discharged their cheques for wages due at the time of lay-off or discharge must be delivered on the same date. If the cheques due to the employee at time of lay-off or discharge are not delivered on the date of lay-off or discharge, the employee shall be entitled to waiting time or reporting time, subsistence allowance, or camp privileges, where applicable, for each day up to and including the date upon which the cheques are delivered. The Employer and the Local Union may agree at the Conference that, on jobs with works less than one hundred (100) employees, if the Employer is unable to deliver the employee’s cheque for wages due at the time of lay-off or discharge, the employee will not be eligible for further waiting or reporting time, subsistence allowance, or camp privileges, however, this final cheque must be mailed to the employee’s home address within twofour

WORKING RULES. 1. The Business Manager, Assistant Business Manager, Business Agent and Financial Secretary shall have the authority of going on all jobs where employees of the Employer are working. 2. There shall be the sole judge as to the number only one member of employees required. It is recognized that the work of handling clamps, lining up of pipe and the making of joints is the work any firm not a member of the Union. If outside clamps are used, a Welder Helper All employees covered by this Agreement shall be assigned to handle such clamps. On pipelines of 14" in diameter or less, the operation of the bending mandrel furnished with an adequate change house and the handling of clamps it shall be performed by a Graded Helperheated between October 1 and April 30. On pipelines of greater than 14" in diameter the handling of clamps and the operation of bending mandrels There shall be performed by, Journeymen. If any additional employees are needed, they shall be employed as Journeymen or Helpers depending on what work is involved. On small jobs when less than at least five (5) Welders feet square or twenty-five (25) square feet of floor space for each man. No material shall be stored in change house area. These change houses and/or trailers to be equipped with benches and tables. 4. Employees covered by this Agreement shall be furnished at the job site with flush type toilet facilities. These toilets may be connected to an existing sewer line or a septic system. Jobs employing ten (10) men or less or for a period of one month or less may use chemical toilets and urinals in place of permanently connected facilities. In no case shall employees be required to work on a construction job where the toilet facilities do not comply with all the laws of the State of New Jersey. These facilities shall be supplied with running water for employees to wash and shall be adequately heated. 5. No Employer shall lease or hire any automobile or other vehicle from any employee covered by this Agreement nor shall any employee furnish any automobile or other vehicle to any Employer or make any arrangement with an Employer to transport men or material other than to provide personal transportation to and from work at the beginning and end of each shift. 6. Whenever the employees covered by this Agreement are required to use a time clock on any job, employees shall ring in on their own time in the morning but shall ring out at the end of the working day on the Employer‘s time. It is the intent and purpose of this paragraph to require that the last employee leaving the job shall ring out his time card no later than the regular quitting time. Time clocks shall be placed at the entrances and exits of jobs. 7. Journeymen shall not be required to use laborers to assist them. If assistance is required, other journeymen or apprentices must be employed. All fitter-welders shall have a fitter with him for set up. Safety to be adhered to at all times. 8. All pipe up to and including 2‖ diameter shall be fabricated on the job or shop in the jurisdiction of Local 322 using Local 322 members. All pipe supports coming under the jurisdiction of the U.A. shall be fabricated on the job site by employees covered by this Agreement. Catalogue items such as U-bolts, pipe clamps, etc., shall be excluded. 9. Journeymen employees of the Employer shall unload all material pertaining to the trade at point of delivery on the job site and distribute same to place of installation or storage. All tool rooms and stock rooms which dispense tools and material to be used by the employees of the Employer shall be manned by journeymen employees. A. When an ―A‖ frame is used, it shall be manned by at least two (2) journeymen. B. Whenever the use of a crane or cherry picker is required to unload or install any piping or equipment included in the work jurisdiction of the United Association, the Welder Employer shall assign a signal man to such piece of equipment who is a qualified journeyman covered by this Agreement. 10. All supplies, materials and equipment delivered to the job site shall be unloaded, stored and handled only by employees covered by this Agreement. At least one journeyman shall be employed on the job from the commencement of such deliveries. 11. All employees of the Employer shall be allowed a coffee break in the morning. Employer and ▇▇▇▇▇▇▇ will be allowed to work with the tools, at the discretion of the Employer. At the beginning and end of larger jobs where more than five (5) Welders will be or have been employed, at any given time, the Welder ▇▇▇▇▇▇▇ will be allowed to work with the tools where it is not a full-time work day task.
