▇▇▇▇▇▇▇ Clause. The Business Manager of the Union shall have the right to appoint a ▇▇▇▇▇▇▇ at any shop or job or on any crew where workers are employed under the terms of this Agreement. The Employer shall not make transfer of any ▇▇▇▇▇▇▇ from the shop or job or crew to which he was appointed to another shop or job or crew without first having notified the Business Manager of the Union of his/her desire to make such transfer and having secured Union's approval of the transfer proposed. Such ▇▇▇▇▇▇▇ shall see that this Agreement and Working and Safety Rules are observed and he shall be allowed sufficient time and be furnished necessary transportation to perform these duties during regular working hours. Under no circumstances shall the Employer dismiss, or otherwise discriminate against, an employee for making a complaint or giving evidence with respect to an alleged violation of any provision of the Agreement. The ▇▇▇▇▇▇▇ shall be included in all overtime at his/her headquarters whenever feasible. The Business Manager shall remove from his/her duties any ▇▇▇▇▇▇▇ at any time he considers the best interest of the Local Union will be served thereby and shall notify the Employer immediately of such removal. Among the duties of the ▇▇▇▇▇▇▇ are to:
▇▇▇▇▇▇▇ Clause. All equipment shall be manned as provided in Schedule "A" and in addition to the ▇▇▇▇▇▇▇ provisions therein contained, when an Operating Engineer requires assistance in addition to any that must be provided for, the Operating Engineer will be assisted by an employee covered by this Agreement in accordance with accepted practices within the Pile Driving and Dredging Industry, or as may mutually be agreed between the Employer and the Union or journeyman operator.
▇▇▇▇▇▇▇ Clause. All equipment shall be manned in accordance with the classifications listed in Schedules "A1" and "A2" and in addition to the ▇▇▇▇▇▇▇ Provisions therein contained, when an Engineer requires assistance in addition to any that must be provided for, he shall be assisted by an Employee covered by this Agreement.
▇▇▇▇▇▇▇ Clause. If any provision of this agreement shall be found contrary to law, it shall be severed from the agreement and all other provisions or applications of the agreement shall continue in full force and effect.
▇▇▇▇▇▇▇ Clause. If any court finds any portion of this Agreement to be contrary to law, invalid, or unenforceable, the remainder of the Agreement will remain in full force and effect.
▇▇▇▇▇▇▇ Clause. The Contractor agrees to recognize the right of the Union to select a ▇▇▇▇▇▇▇ from the working force on the job site. A ▇▇▇▇▇▇▇ shall be required to do a full day’s work. The Union and the Contractor shall determine the ▇▇▇▇▇▇▇’▇ duties at the Pre Job Conference.
▇▇▇▇▇▇▇ Clause. Should any article, section, or clause of this Agreement be declared illegal by a court of competent jurisdiction, said article, section, or clause, as the case may be, shall be automatically deleted from this Agreement to the extent that it violated the law. The remaining articles, sections, and clauses shall remain in full force and effect for the duration of the Agreement if not affected by the deleted article, section, or clause.
▇▇▇▇▇▇▇ Clause. ‌ The Business Manager may appoint one ▇▇▇▇▇▇▇ from within the bargaining unit membership, and immediately notify the employers representative of the selection, whose duty it will be to see to it that this contract is adhered to and that all work coming under the jurisdiction of the Union is performed by employees covered by this Agreement. The ▇▇▇▇▇▇▇ will be permitted, with notification to their supervisor, reasonable time without loss of pay during working hours to process grievances.
▇▇▇▇▇▇▇ Clause. Except as this Agreement shall otherwise provide, all terms and conditions of employment applicable on the signing date of this Agreement to employees covered by this Agreement as established by the rules, regulations and/or policies of the Board in force on said date shall continue to be so applicable during the term of this Agreement.
▇▇▇▇▇▇▇ Clause. Section 1. The Business Manager may appoint a ▇▇▇▇▇▇▇ or a company ▇▇▇▇▇▇▇ on all projects or portions of projects, whose duty it will be to see to it that this contract is adhered to and that all work coming under the jurisdiction of the Union is performed by employees covered by this Agreement. Section 2. The ▇▇▇▇▇▇▇ is to perform all duties assigned to him by the Business Manager. The ▇▇▇▇▇▇▇ is to work the same as any other employee on the job. Section 3. It shall be the duty of the ▇▇▇▇▇▇▇ to report to the Union any accident to any of the men which may occur on the job where employed. It shall be the duty of the ▇▇▇▇▇▇▇ to personally see to it that the injured employee is taken care of and his family notified without loss of time or pay to the ▇▇▇▇▇▇▇ so engaged. Any employee injured on a job who is unable to return to the job by written order of the doctor that day, shall receive a full day’s pay. If he returns to the job that day, he shall be paid full time for the time lost. If the employee's occupational injury permits him to continue to work, but require subsequent visits or necessary medical treatment during his scheduled work hours, he will be paid for the time lost from his scheduled work in making such visits. Section 4. The ▇▇▇▇▇▇▇ shall not be transferred from one project to another without getting consent from the Business Manager. Section 5. The Employer shall recognize the right of the Union to select a ▇▇▇▇▇▇▇ from among its employees to perform the duties assigned to the ▇▇▇▇▇▇▇ by the Union. Section 6. The ▇▇▇▇▇▇▇ shall not be discharged because he is performing his duties as a ▇▇▇▇▇▇▇, nor shall the ▇▇▇▇▇▇▇ be discriminated against because of his affiliation with the Union or because of his activities on behalf of the Union. Section 7. The ▇▇▇▇▇▇▇ shall work when there is any work to be performed by the laborers. He shall be the last man on the job if qualified. No ▇▇▇▇▇▇▇ shall be discharged without the Employer conferring with the Business Manager of the Local Union involved, and a mutual understanding arrived at. The ▇▇▇▇▇▇▇ shall be allowed a reasonable amount of time when necessary to police the job. Section 8. When an Employer sees fit to discharge an employee or employees or have a reduction in the work force, he is to notify the ▇▇▇▇▇▇▇ before taking such action. Section 9.
