Delay Events definition

Delay Events has the meaning given to it in Clause 12.2 (Time for Completion);
Delay Events means delays caused by any act, default or omission by Us or other contractors engaged by Us on Site (who are not otherwise employed by You);
Delay Events has the meaning given in Section 39.1(a) of the Project Agreement.

  • Representative shall, after receipt of written details under Clause 30.4 (Delay Events and Compensation Events ), or of further particulars under Clause 30.5 (Delay Events and Compensation Events ), be entitled by notice in writing to require Project Co to provide such further supporting particulars as he may reasonably consider necessary.

  • Without limiting Contractor’s rights with respect to non-monetary relief for CA Delay Events in accordance with Section 12.5, the Contract Sum Adjustment as expressly provided in this Agreement will represent the sole right to compensation and damages for the adverse effects of a CA Compensation Event.

  • As provided in this Section, a noncompensable extension of Contract Time is CM/GC’s sole remedy for any delays not the fault of CM/GC or its Subcontractors, except those delays specifically listed in Section 1.4.2.3. Extensions of Contract Time will be granted for Abnormal Weather Delay Days and Other Noncompensable Delay Events that delay the critical path of Work based on the Overall Project Schedule, subject to the provisions below.

  • As a condition precedent to such extension, CM/GC shall comply with Section 1.4.2.1, Section 1.4.2.1.4, Section 1.4.2.1.5, and Section 1.4.2.1.6, as if such Sections applied to delays caused by Other Noncompensable Delay Events instead of Abnormal Weather Delay Days, and shall submit a Claim as described in Section 5.2.2.

  • Monolith Solar shall be in default of this Agreement if the following (“Monolith Solar Events of Default”) shall occur: (i) Monolith Solar fails to perform any material obligation hereunder, such failure is material, such failure is not excused by Excusable Delay Events or other provisions of the Agreement, and Monolith Solar fails to commence a cure of the default within a commercially reasonable period of time and diligently proceed with the cure until completion.

Delay Events. The Target Completion Date may be extended and the Programme amended by any delays to the Works which are caused by: the Company’s failure to perform its obligations under this Connection Agreement or any other delay, impediment or prevention of whatever nature caused by the Company or for which it is responsible which will impact on the Works, provided, however, that the ability to extend the Target Completion Date in these circumstances shall in no way prejudice Gas Networks Ireland’s right to exercise its right to terminate this Connection Agreement for material breach in accordance with Clause 13.1 or 13.3; changes or variations to the design specification of the Works required by the Company and agreed by Gas Networks Ireland; omissions or errors in information or design specifications (including any aspect or element of the Works but) which Gas Networks Ireland become aware of after the Agreement Date; compliance with any Legal Requirements; accidental loss or damage to any completed part of the Works caused by third parties; the encountering of physical conditions, geotechnical conditions, archaeological finds or artificial obstructions on or in the vicinity of the Project Site or Pipeline Route; any event or circumstances of Force Majeure; the discovery of Toxic and Dangerous Waste; any labour dispute or work stoppage or slow down involving the Company, the Company’s contractors, subcontractors or the unions of the workers of the Company or of the Company’s contractors or subcontractors; delay in the delivering of, or market constraints in the availability of any of the Materials required for the Works; failure or delay in obtaining Easements; failure or delay in issuing of Relevant Approvals or any Relevant Approval ceasing to be in force, or any condition on such a Relevant Approval preventing Gas Networks Ireland from performing its obligations; the exercising by Gas Networks Ireland of its right to suspend performance of the Works pursuant to Clause 9.8.1; delay by the Company in achieving any of the Conditions Precedent and Gas Networks Ireland has elected not to terminate this Connection Agreement in accordance with Clause 3.5; delay caused as a result of any third party objection or judicial review proceedings brought in respect of any planning permission obtained by the Company in relation to the Connection Facilities or Offtake Facilities as the case may be; or delay caused as a result of any third party objection or judicial review procee...
Delay Events means a delay caused by any of the matters referred to and as set out in Clause 18.1 (Delay Events);

Related to Delay Events

  • Delay Event means: (i) a tsunami, flood, cyclone, earthquake, bushfire or other act of nature; (ii) riot, civil commotion, war, invasion or a terrorist act; (iii) an imminent threat of an event in paragraphs (i) or (ii); or (iv) compliance with any lawful direction or order by a Government Agency; or (v) if clause 2.5 applies, the computer system operated by the ATO for the GST Withholding notifications referred to in clause 2.5(5)(c) is inoperative;

  • Termination Events means each of the events specified in Clause 10.3 of this Contract.

  • Triggering Events means Triggering Event I, Triggering Event II and Triggering Event III, collectively.

  • Extraordinary Events Any of the following conditions with respect to a Mortgaged Property (or, with respect to a Cooperative Loan, the Cooperative Apartment) or Mortgage Loan causing or resulting in a loss which causes the liquidation of such Mortgage Loan:

  • Liquidity Event of Default means the occurrence of either (a) the Acceleration of all of the Equipment Notes or (b) an American Bankruptcy Event.
