Derivative Data definition
Derivative Data means any credit scores, credit information, behavioural projections, profiling, analytical results, reports (prepared by the Bank internally or other persons) including through any algorithms, analytics, software, automations, profiling etc., and whether such derivative is from the information collected from me/us or in combination with any other information sourced from any other person, database or source whether by the Bank or other persons. The process of arriving at and generation of such Derivative Data involving or through any of the above sub-processes/methods, shall be referred to as “Derivation”.
Derivative Data means data or information based on or created from Confidential Data.
Derivative Data means any and all data that result from the commingling or other aggregation of the Customer Data and/or the Provider Data.

Results of such analysis are considered Derivative Data, and when exported back to Participant’s computers are not permitted to contain Raw Data nor can any exported results contain identifying information.
All publication of Derivative Data must include acknowledgment of DNS-OARC as the source of the Data.
If DHHS determines that there may have been an Incident or Breach of the Confidential Data or individually identifiable information or Derivative Data by the ENTITY, its End Users, contractors or a third party, DHHS may, in its sole discretion, immediately and unilaterally terminate this Agreement upon notice to ENTITY.
The ENTITY agrees to cease using and return and/or destroy all Confidential Data and Derivative Data and any copies in its possession, and to arrange for the return of all Confidential or Derivative Data in the possession of any contractor or third party, immediately upon notice from DHHS of termination for an Incident or Breach.
BetterBot shall own all rights in and to Derivative Data, and may use, disclose and transfer Derivative Data in any way it wishes.

Derivative Data shall also include all modifications, compilations, derivative works and results from processing (including analyses, usage statistics and patterns, datasets, databases, reports, recommendations and visual representations) created or developed from Customer Data or on the basis of Customer’s use of the Services In the event that Customer is a U.S. government user, any software licensed in connection with the Services is provided with restricted rights: (a) If the Customer is a civilian agency, the software: (i) was developed at private expense and is existing computer software and no part was developed with government funds; (ii) is a trade secret of DAXKO for all purposes of the Freedom of Information Act; (iii) is a commercial item and thus, pursuant to Section 12.212 of the Federal Acquisition Regulations (FAR), the government’s (and any government agency’s) use, duplication or disclosure of the software is subject to the restrictions set forth in this Agreement; (iv) is in all respects proprietary data of DAXKO and all rights are reserved under the copyright laws of the United States; (b) If the Customer is part of the Department of Defense, the Software is commercial computer software (and commercial computer software documentation), and pursuant to DFAR § 227.7202, use, duplication or disclosure of the software is subject to the restrictions set forth in this Agreement. In the event any technical data are not covered by these provisions, it shall be deemed “technical data-commercial items” pursuant to DFAR § 252.227- 7015(a). Any use, modification, reproduction, release, performing, displaying, or disclosing of such technical data shall be governed by the terms of DFAR § 252.227-7015(b).
Derivative Data means the resulting data extracted and/or processed by the Customer from the Service.
Derivative Data means any data that is derived by processing the Network Data and that is sufficiently different from the Network Data so that such Network Data cannot be reverse engineered or otherwise identified from analysis or further processing. “Derivative IP” shall mean any intellectual property created by or on behalf of Adtran within one (1) year after the expiration or earlier termination of an Order that includes Network Data in any form or that is derived in any sense from the Network Data, including, without limitation, any expression of the same via source code, object code, and associated documentation developed or modified by Adtran.
