Excluded Improvements definition

Excluded Improvements means all Improvements other than the Acquired Improvements.
Excluded Improvements has the meaning defined in Paragraph “D” of the “Recitals” portion of this Agreement.
Excluded Improvements means those fixed and permanent improvements to the Premises which Tenant can prove to Landlord’s reasonable satisfaction were installed and paid for by Tenant during the 120 months immediately prior to the then applicable expiration date of the Base Term and which Landlord could require under this Lease to remain in the Premises upon expiration of the Base Term of this Lease. If, on or before the date which is 180 days prior to the expiration of the Base Term of this Lease or any prior Extension Term, Tenant has not agreed with Landlord’s determination of the Market Rate and the rent escalations for the applicable Extension Term after negotiating in good faith, Tenant shall be deemed to have elected arbitration as described in Section 40(b). Tenant acknowledges and agrees that, if Tenant has elected to exercise an Extension Right by delivering notice to Landlord as required in this Section 40(a), Tenant shall have no right thereafter to rescind or elect not to extend the term of the Lease for such Extension Term.

Examples of Excluded Improvements in a sentence

  • Excluded Improvements can be added by Customer to the Services pursuant to an Order Form.

  • The terms "property," "Tract 1," and "Tract 2" as used in this Agreement, shall expressly exclude all telecommunication facilities, electric facilities, sanitary sewer, storm sewer, water pipelines, and chemical products pipelines including oil, gas and other petrochemical products pipelines situated within the Property (the "Excluded Improvements") that are not owned by Seller.

  • Excluded Improvement: The Excluded Improvements shall include the following buildings, structures and improvements: the station with the aerator monitoring equipment, the boat dock that contains that certain overhead crane, the maintenance shop for the aerator equipment, and the substation structure which contains certain electrical equipment, all of which are situated on Land Lot 161, as shown on the survey prepared by ▇▇▇▇ ▇.

  • Excluded Fixtures: The Excluded Fixtures shall include all of Performance Fibers’ interest in all fixtures, materials, supplies, equipment, systems, machinery, apparatus, furniture, furnishings, appliances and other items of personal property now owned or hereafter acquired by Performance Fibers and now or hereafter attached to, installed in, situated in, on or about or used in connection with any of the Excluded Improvements.

Related to Excluded Improvements

  • Leased Improvements shall have the meaning given such term in Section 2.1(b).

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.

  • System improvements means capital improvements to public facilities which are designed to provide service to a service area.

  • Leasehold Improvements means all buildings, structures, improvements and fixtures located on any Leased Real Property which are owned by any Group Company, regardless of whether title to such buildings, structures, improvements or fixtures are subject to reversion to the landlord or other Third Party upon the expiration or termination of the Lease for such Leased Real Property.

  • Site Improvements means any construction work on, or improvement to, streets, roads, parking facilities, sidewalks, drainage structures and utilities.
