(b) Shall act as liaison between ARTISTS and AGMA. (c) Shall report any violations of this agreement both to the EMPLOYER and to AGMA. (d) Shall conduct meetings pertaining to AGMA business at such times not to conflict with rehearsals or performances, and EMPLOYER will endeavor to make a facility available for such meetings. (e) Shall at all times have the right to bring matters of safety to the attention of EMPLOYER. The AGMA delegate shall have no authority to stop or interfere with any part of any performance or rehearsal or interfere in any way with the performance of the duties of the EMPLOYER except when authorized by the National Office of AGMA to stop professional activities due to lack of payment for services, failure to post a requested bond, or if Employer fails to perform as set forth in Paragraph 32 (e) and (f) below.

E. Shall conduct meetings scheduled on days of rehearsal or performance and pertaining to AGMA business only before or after rehearsals or performances, and shall schedule such meetings so as not to interfere with rehearsal or performance. MANAGEMENT will endeavor to make a facility available for such meetings. F. Shall at all times have the right to bring matters of safety to the attention of MANAGEMENT.
AGMA DELEGATES AND REPRESENTATIVES. A. AGMA may represent the employees covered under and as stated in Article 1 in any dispute with EMPLOYER. B. AGMA Staff Representative shall notify EMPLOYER, in writing, of the names of the AGMA Delegates assigned to EMPLOYER. Should the Delegate or Representative change during the life of this Agreement, AGMA shall identify the new Delegate and/or Representative to EMPLOYER. C. An AGMA Representative wanting access to locations where CHORISTERS are working or are scheduled to work shall request permission for such access from EMPLOYER, in writing, 24 hours in advance. EMPLOYER shall cooperate in these requests whenever possible. EMPLOYER will submit denials of any such access in writing to AGMA. AGMA Delegates may access such locations without notice, provided that they do not interrupt the work and follows EMPLOYER’S instructions with respect to more convenient times. D. If AGMA conducts union meetings scheduled on days of rehearsal or performance and pertaining to AGMA business, they should be scheduled before or after rehearsals or performances so as not to interfere with such Services. Union meetings held in a facility of EMPLOYER must end one half hour preceding rehearsal and shall be limited to one half hour after rehearsal. EMPLOYER will endeavor to make a facility available for such meetings if requested and upon availability. If AGMA wishes to conduct union meetings pertaining to AGMA business on days when rehearsals or performances are not scheduled, then EMPLOYER will make available up to twice a year on mutually agreed upon dates space at the Arizona Opera Center for AGMA to conduct meetings for such purposes. E. The AGMA Delegate or Representative shall at all times have the right to bring matters of health, safety, and hygiene to the attention of EMPLOYER.

(e) Shall conduct meetings pertaining to AGMA business at such times not to conflict with rehearsals or performances, and OPERA THEATRE will endeavor to make a facility available for such meetings. (f) Shall at all times have the right to bring matters of safety to the attention of OPERA THEATRE. The AGMA delegate shall have no authority to stop or interfere with any part of any performance or rehearsal or interfere in any way with the performance of the duties of the OPERA THEATRE except when authorized by the National Office of AGMA to stop professional activities due to lack of payment for services or failure to post a requested bond.

Shall confer with the EMPLOYER for the purpose of scheduling an AGMA meeting during the first rehearsal week. g. The AGMA delegate shall have no authority to stop or interfere with any part of any performance or rehearsal or interfere in any way with the performance of the duties of the EMPLOYER except (1) when authorized by the National Office of AGMA to stop professional activities due to lack of payment for services or failure to post a requested bond or (2) if EMPLOYER fails to perform as set forth in Paragraph 28.e.

The EMPLOYER agrees to provide AGMA representatives a roster of ARTISTS engaged to date for each production, indicating the roles to be performed by each ARTIST engaged, no less than six (6) weeks prior to the first scheduled rehearsal of such production or as soon thereafter as practicable. The EMPLOYER shall update the roster at regular intervals. G. The EMPLOYER agrees that it will not discriminate against any ARTIST in compensation, performances, engagements or in its general relationship with the ARTIST, because of the ARTIST’s activities on behalf of AGMA. H. CHORISTERS who serve as AGMA delegates in a production will, at the conclusion of each chorus rehearsal, sign the chorus sign-in sheet that records the CHORISTER attendance and the number of hours worked at the rehearsal. I. The AGMA delegate shall have no authority to stop or interfere with any part of any performance or rehearsal or interfere in any way with the performance of the duties of the EMPLOYER except when authorized by the National Office of AGMA to stop professional activities due to lack of payment for services. J. AGMA may represent ARTISTS in any dispute which may arise with the EMPLOYER. The EMPLOYER shall not dismiss or otherwise penalize any ARTIST for fulfilling their duties or obligations as a delegate or as an AGMA member. Any AGMA delegate or member who claims that the EMPLOYER has given them notice, or otherwise penalized or discriminated against them for fulfilling their duties, either as a delegate or as an AGMA member, may present their case to AGMA which shall give the EMPLOYER an opportunity to be heard if it desires to avail itself of this opportunity. (b) Shall act as liaison between ARTISTS and AGMA. (c) Shall report any violations of this Agreement both to the MANAGEMENT and to AGMA. (d) Shall conduct meetings pertaining to AGMA business at such times not to conflict with rehearsals or performances, and MANAGEMENT will endeavor to make a facility available for such meetings. AGMA agrees meetings will not be conducted just prior to performances or during intermissions of performances. (e) Shall at all times have the right to bring matters of safety to the attention of the MANAGEMENT.

During the first week of rehearsals each year for Choristers and Young Artists, and the first week of each production for Principal Artists and Stage Staff (i.e. Stage Managers, Assistant Stage Managers, Stage Directors, Assistant Stage Directors), Artists shall elect the number of delegates specified below, provided someone is willing to serve.

(b) Within 15 business days of the last day worked, EMPLOYER shall provide the ARTIST and AGMA with the following: (1) Principal Artists and Stage Directors: statement of fees and per diem. (2) Stage Management and Choreographers: statement of number of weeks and days worked, fees, overtime, and per diem.

(b) Shall act as liaison between ARTISTS and AGMA. (c) Shall report any violations of this Agreement both to COT and to AGMA. (d) ▇▇▇▇▇ conduct a fifteen (15)-minute meeting during the first staging rehearsal of each production in a season at a mutually convenient time at the beginning of a rehearsal of each production in a season and, with reasonable advance notification, may conduct meetings pertaining to AGMA business at other times not to conflict with rehearsals or performances, and COT will endeavor to make a facility available for such meetings, provided that COT will not be responsible for any additional costs which may arise from the provision of such facility. The first fifteen (15) minutes of the first (1st) full Chorus rehearsal of the season shall be devoted to a Chorus Meeting for the explanation of Union Rules and Working Conditions, which meeting may coincide with one of the above meetings at the beginning of a rehearsal period. (e) Shall at all times have the right to bring matters of safety to the attention of ▇▇▇. The AGMA delegate shall have no authority to stop or interfere with any part of any performance or rehearsal or interfere in any way with the performance of the duties of COT except when authorized by the National Office of AGMA to stop professional activities due to lack of payment for services or failure to comply with paragraph 10 or failure to abide by the provisions of Paragraph 33(d) of this Agreement. AGMA agrees to notify COT in writing at least one week prior to any authorization to stop professional activities as provided herein.
