Cancellation of Contract by the Student. You are responsible for the full amount of all housing charges for the Contract Period, unless you cancel the Contract in compliance with one of the provisions below. a. Before the start of the Contract Period: 1. For occupancy period Fall/Spring Semester-9month contract, You may cancel your Contract by notifying the DHRL in writing before July 1. If you cancel your Contract after July 1st up until August 1st for the Fall Semester you will be charged a $300 housing termination fee. If you cancel the Contract prior to or on July 1st for Fall you will receive a refund of your Deposit minus the application fee. If you cancel after August 1st up until Official Record Date (Census Day, 12th Class Day for Fall), you will be charged $500 as a housing termination fee and forfeit your deposit. Becomes married (copy of marriage license required.) 3. Is a varsity athlete, in good standing, and is "placed" by his/her head coach into a varsity athletic program at a four-year school. Approval of the ▇▇▇▇ of Student Services is required. 4. Suffers a catastrophic loss resulting from events beyond the control of the student. Approval of ▇▇▇▇ of Student Services. Final approval from the Dorm/Housing Director or designated representative will be required before these fees may be waived. Cancellation of Contract by the Student a. Resident can cancel this Contract upon documentation of acceptable grounds and subject to the payment of a cancellation fee as set forth herein. Resident must submit a written request for cancellation via the Living@TU Portal that includes third-party supporting documentation acceptable to the University supporting one of the reasons listed within this section. The student remains responsible for their obligations under this Contract unless and until: (i) the student receives written notice of that the University has approved the student’s cancellation request, and (ii) the student follows the instructions within the notice. Submission of a Contract Cancellation Request does not guarantee approval. Each request will be reviewed and considered on its own merit. b. A student may request a release from this Contract only for the following reasons: i. separation (e.g., transferring, withdrawing, suspension) from the University; ii. graduating in December/January; iii. participation in a University-sponsored activity, such as student teaching, study abroad, exchange programs or internships, any of which are beyond a 20-mile radius from the assigned housing, or which may present a significant logistical challenge for the student to participate in the University-sponsored activity; iv. medical withdrawal processed through the Office of Student Outreach and Support; v. enrolled in all online/remote classes; vi. military duty; vii. marriage; viii. pregnancy; ix. existence of a documented injury, illness, medical condition, or other exceptional circumstance that occurs after the execution of the housing contract which cannot be accommodated within the University’s housing system; and x. not carrying the minimum of 12 units. c. Any cancellation granted based on a resident request made under false pretenses will be deemed null and void, and the resident will remain subject to the terms and conditions of this Contract, reassigned to housing, and required to participate in an approved meal plan, unless the resident is reassigned to housing that does not require a meal plan. In addition, any cancellation made under false pretenses may result in referral to the Office of Student Accountability and Restorative Practices for disciplinary action. d. When a resident is released from their Contract, they must vacate the assigned space within 72 hours.
