Certification Tests. 4.1 With respect to a Business Day to be chosen by the IESO in its sole discretion between May 1, 2017 and May 5, 2017, the IESO shall issue a test Standby Notice and test Activation Notice that would otherwise be in accordance with Section 3.0 of Schedule 7, except that the Activation Period shall only be one hour as specified in the test Activation Notice (the “Test Activation”). If the Measurement Data in respect of the Certification Test shows that the Service Provider caused the Demand Response Resource to provide Delivered Demand Response in an amount greater than or equal to 85% of the Contract Capacity multiplied by one hour, the test shall be considered passed, otherwise, the test shall be considered failed. 4.2 If the Certification Test is failed, then with respect to a Business Day to be chosen by the IESO in its sole discretion between May 15, 2017 and May 19, 2017, the IESO shall issue a subsequent test Standby Notice and test Activation Notice that would otherwise be in accordance with Section 3.0 of Schedule 7, except that the Activation Period shall only be one hour as specified in the test Activation Notice (the “Second Test Activation”). Certification Tests. This Agreement applies only to versions of Product that have successfully passed the technical certification tests ("Certification Tests") developed and updated from time to time by Sun and run by a third party certification center chosen by Sun in Sun's sole discretion ("Certification Center"). The Certification Tests verify that a submitted software product meets the 100% Pure Java certification standards ("Certification Standards"), which are that the software is written completely and exclusively in Sun's JAVA programming language, that it contains no native method calls, that it conforms to core JAVA API specifications, and that such software product will function similarly on appropriate browsers or platforms including but not limited to: HotJava Browser, Microsoft Internet Explorer, Netscape Navigator, Solaris, JavaOS, Windows 95/3.l/NT MacOS ("Required Environments"). Certification Tests. Test plans and other substantiation data submitted simultaneously to each Technical Agent for review shall receive joint approval or concurrence, as appropriate, by both Technical Agents. The test(s) will be conducted in accordance with the jointly approved test plan and witnessed according to the procedures of the Technical Agent in whose jurisdiction the test is conducted. Due to possible unforeseen circumstances that might arise during the actual testing, the witnessing Technical Agent may exercise judgment and permit certain deviations from the test plan, while trying to satisfy the certification requirements of both Technical Agents. In this regard, it is possible that some tests might have to be repeated in order to satisfy the certification requirements of the other Technical Agent. It is, therefore, important that the test plans are well detailed and that proper communication is established between the Technical Agents to alleviate the need for additional testing.

  • Drug-Free Workplace Certification As required by Executive Order No. 90-5 dated April 12, 1990, issued by the Governor of Indiana, the Company hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace at the Project Location. The Company will give written notice to the IEDC within ten (10) days after receiving actual notice that the Company, or an employee of the Company in the State of Indiana, has been convicted of a criminal drug violation occurring in the workplace. False certification or violation of this certification may result in sanctions including, but not limited to, suspension of payments under the Agreement, termination of the Agreement and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraph, if the total amount set forth in the Agreement is in excess of $25,000.00, the Company agrees that it will provide a drug-free workplace by: A. Publishing and providing to all of its employees a statement notifying them that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the Company’s workplace, and specifying the actions that will be taken against employees for violations of such prohibition;

  • Certification of Compliance The Recipient shall complete and submit the following Notice of Completion and, if applicable, Engineer’s Certification of Compliance to the Department upon completion of the construction phase of the Project.
