Communication with Customers. Nothing in this Agreement is intended to limit Facility’s right or ability to communicate fully with a Customer and the Customer’s physician regarding the Customer’s health condition and treatment options. Facility is free to discuss all treatment options without regard to whether or not a given option is a Covered Service. Facility is free to discuss with a Customer any financial incentives Facility may have under this Agreement, including describing at a general level the payment methodologies contained in this Agreement. Facility may also assist a Customer in estimating the cost of a given Covered Service.
Communication with Customers. Nothing in this Agreement is intended to limit Medical Group’s or Medical Group Professional’s right or ability to communicate fully with a Customer regarding the Customer’s health condition and treatment options. Medical Group and Medical Group Professionals are free to discuss all treatment options without regard to whether or not a given option is a Covered Service. Medical Group and Medical Group Professionals are free to discuss with a Customer any financial incentives Medical Group may have under this Agreement, including describing at a general level the payment methodologies contained in this Agreement.
Communication with Customers. Upon the occurrence and during the continuance of an Event of Default and Lender commencing enforcement actions, Lender is authorized to communicate directly with Borrowers’ customers regarding Borrowers and Borrowers’ business relationship and authorizes Lender to obtain, and the customers to provide, information and documentation regarding Borrowers’ performance of its contracts, purchase orders and other obligations to these customers. The foregoing will not limit, in any way, Lender’s right to communicate with customers for purposes of verifying Accounts.
Communication with Customers. Communication with Customers. Distributor and the Company will cooperate with each other in conveying information regarding the logistics of the Depot program to customers, Distributor’s terms of sale under the Depot, and Distributor’s policies and procedures for processing new account applications for Customers.
Communication with Customers. Seller and Buyer shall cooperate to develop a joint communication plan regarding transfer of the Transferred Business from Seller to Buyer and to facilitate the effective continuation of the Transferred Business on the Closing Date and to minimize transfer issues with the customers of the Transferred Business on or after the Closing Date.
Communication with Customers i. The Seller shall ensure that any and all correspondence with any Customer shall:
a. be solely for the purposes of processing and/or progressing a Customer order;
b. be via the Seller Portal or, if that is not possible, then at all times include a reference to ▇▇▇▇▇▇▇.▇▇▇;
c. not include any reference to the Seller's own website, email address, other correspondence address or any other promotion of services outside those offered through or by FodaBox.
ii. The obligations under Clause 6.C.i shall include any material included with the dispatch of a Customer’s order. FodaBox shall make relevant materials available to purchase on the Seller Portal to help the Seller to fulfil this obligation.
iii. Any breach of these Clauses 6.C.i or 6.c.ii shall constitute a material breach of these Conditions and, further, may constitute a breach of data protection legislation laws.
iv. The Seller shall respond to any Customer enquiries or Customer complaints promptly and courteously in the first instance within one (1) Working Day through the Seller Portal, and shall advise FodaBox of any escalated unresolved Customer enquiries as soon as reasonably practicable.
7. Your use of the Seller Portal
i. The Seller shall not:
a. use the Seller Portal or FodaBox Website beyond the scope of use set out in these Conditions;
b. access the Seller Portal unlawfully, modify or make derivative works based on the Seller Portal nor attempt to reverse engineer or access the Seller Portal with the intention of creating a competitive product or service nor to copy or build any concepts, features, functions or graphics based on the Seller Portal. The Seller acknowledges that damages may not provide an adequate remedy for breach of this clause and that FodaBox shall be entitled to seek injunctive relief to prevent the occurrence or continuance of any alleged breach of this clause.
ii. The Seller fully acknowledges that the IPR in the Seller Portal are vested exclusively in FodaBox and nothing in the Conditions shall be deemed to vest any rights in the Seller Portal in the Seller.
Communication with Customers. Upon the occurrence and during the continuance of an Event of Default, Borrower authorizes Lender to communicate directly with its customers regarding Borrower and Borrower's business relationship and authorizes Lender to obtain, and the customers to provide, information and documentation regarding Borrower's performance of its contracts, purchase orders and other obligations to such customers; PROVIDED, HOWEVER, that the foregoing shall not limit, in any way, Lender's right to communicate with customers for purposes of verifying Accounts.

In order to maintain the high standards of quality control throughout the System, the Licensor reserves the right to use test customers from time to time, without prior notification to the Licensees, in order to determine whether the Licensed Business is maintaining high standards of quality, integrity, safety, appearance and customer service.
