Common use of Compensatory Time Off Clause in Contracts

Compensatory Time Off. (a) Subject to the operating requirements of the Agency, employees shall have their choice of compensatory time off. If two (2) or more employees request the same period of time off and the matter cannot be resolved by agreement of the employees concerned, the employee having the greatest length of service with the Agency shall be granted the time off. Compensatory time may be used in lieu of vacation leave or sick leave with management approval, provided the employee is not on written notice for attendance issues. (b) Employees shall be allowed the option of taking compensatory time off in combination with vacation leave. However, compensatory time off taken in this manner shall be subject to the provisions of the Vacation Article rather than the provision of this Article.
