Common use of Daily Guarantee Clause in Contracts

Daily Guarantee. a) Employees reporting for work on the call of the Employer, except school students reporting to work on school days and except Recreation Services staff conducting programs shall be paid the Employee's regular rate of pay for the entire period spent at the place of work in response to the call, with a minimum in any one (1) day of: (i) Two (2) hours pay at the Employee's regular rate, except where the Employee's condition is such that he is not competent to perform his duties, or he has failed to comply with the Industrial Health and Safety Regulation of the Workers' Compensation Board; and (ii) With the exception of Recreation Services staff, any Employee that commences work, four (4) hours pay at the Employee's regular rate, except when his work is suspended because of inclement weather or other reasons completely beyond the control of the Employer. (iii) For the purpose only of this article (ii) and (iii), Recreation Services staff comprise the classifications of Skate Patrol, Program Workers, Pre-school/Program Instructors, and Lifeguards/Instructors who are not Regular Full-Time Employees. Recreation Services staff shall be paid a minimum of two (2) hours pay at the Employee’s regular rate of pay. It is understood that ‘free-standing’ two (2) hour programs will not be scheduled as a matter of course, but will be the exception; four (4) hour blocks will be scheduled whenever possible. b) School students reporting for work on school days on the call of the Employer. The Employee's regular rate of pay for the entire period spent at the place of work in response to the call, with a minimum in any one (1) day of two (2) hours' pay at the Employees' regular rate.
