Declaration of Covenants. 15. Before the sale and/or lease of any MPDU on the Property, the Developer shall execute a Declaration in the form provided by the Department, and such Declaration shall be recorded among the land records of ▇▇▇▇ Arundel County, Maryland at the Developer’s expense. The Developer shall submit a completed Declaration to the Department for review and final approval prior to recordation. 16. The Declaration governing MPDUs shall contain a statement that it runs with the each MPDU and is binding on the successors and assigns of any purchaser or lessee of an MPDU, and that each MPDU is governed by the requirements of Chapter 20.30 of the Code, as may be amended. 17. The Declaration governing MPDUs shall contain a statement that the Developer, without further action or consent required of the Developer, irrevocably grants and assigns to the City the right to enforce the Declaration, to institute any proceeding in law or equity for the collection of such sums as may be in excess of those allowed by law or to enjoin any violation or attempted violation of the Declaration or the provisions of Chapter 20.30 of the Code, as may be amended. 18. Any contract of sale, deed, or lease for any MPDU shall have as an exhibit thereto a copy of the executed, recorded Declaration with the liber and folio numbers referenced.

Declaration of Covenants. The Owner hereby declares that the Project is and shall be held, conveyed, encumbered, leased, used, occupied, improved, and otherwise affected in any manner subject to the provisions contained in this paragraph A of Article II, all of which are hereby declared to be in furtherance of the purpose of providing Very Low and Low-Income housing. All provisions contained in this paragraph shall be deemed to be covenants running with the land or as an equitable servitude, as the case may be, and shall constitute benefits and burdens to the Owner and its successors and assigns and to all persons hereafter acquiring or owning any interest in the Project, however such interest may be acquired. Accordingly, the following covenants, conditions, and restrictions are hereby imposed upon the Project:

Declaration of Covenants. At or before the time of the execution of this Agreement by the Applicant, the Applicant must provide the Department with a signed Declaration of Covenants, in recordable form as provided by the Department, subjecting the MPDUs in the subdivision that are the subject of this Agreement to the requirements of Chapter 25A of the ▇▇▇▇▇▇▇▇▇▇ County Code, 2004, as amended, and all applicable Executive Regulations.

Declaration of Covenants. No earlier than the date of closing of the Purchase Agreement (as hereinafter defined) and no later than the Commencement Date, Landlord shall cause the Hotel Owner as defined in the Declaration of Covenants, Conditions and Restrictions of Bayside Concourse) attached hereto as Exhibit "F" (the "Declaration") to record the Declaration in the public records of Pinellas County, Florida, which Declaration shall impose the restrictions contained therein on the Common Area Parcel, Hotel Parcel and Office Parcel, as defined in the Declaration on both parcels (subject only to the lien of first mortgagees and for taxes not yet due and payable). Landlord shall cooperate with Tenant with respect to the exercise of the rights and remedies of the Owner of the Office Parcel under the Declaration, provided that such cooperation is at no cost to Landlord.

Declaration of Covenants. At or before the time of execution of this Agreement by the Applicant, Applicant must supply the Department with the original and duly executed Declaration of Covenants, in recordable form as provided by the Department subjecting all required MPDUs in the subdivision to the requirements of Chapter 13.5 of the Rockville City Code.

Declaration of Covenants. The Property is not currently subject to a declaration of covenants, conditions and restrictions or similar document.

Declaration of Covenants. Developer has executed a Deed of Declaration of Covenants for the Property, which Deed of Declaration of Covenants contains the covenant provisions set forth below. The Deed of Declaration of Covenants includes covenants running with the land requiring a Minimum Annual Payment until Increment District No. 9 expires or terminates. Developer agrees, during the period of the life of Increment District No. 9, that any document transferring any interest in the land will include the covenants running with the land required by this Agreement.
