Dissemination of Results. During the Action and for the period of time as stated in Section 10.2 of this PCA, the Dissemination of Results by one or several Parties including but not restricted to publications of whatever form (excluding patent applications(s) and other registrations of IPRs), shall be governed by the procedure of Article 29.1 of the Grant Agreement subject to the following provisions: Any publication planned by a Party shall be submitted through written notice to the other Parties at least forty-five (45) days before the planned publication submission date. Any objection to the planned publication shall be made in writing to all Parties within thirty (30) days after receipt of the written notice. If no objection is made within the time limit stated above, the publication is permitted. An objection to a planned publication by a Party is justified if: the protection of the objecting Party's Results or Background is adversely affected; and the proposed publication includes Confidential Information of the objecting Party; or the objecting Party's Legitimate Interests, academic or commercial, would be significantly harmed. Any and all objection(s) shall include, to the extent possible, a precise request for necessary modifications. If an objection has been raised on one or more of the above mentioned grounds, the objecting Party and the publishing Party shall discuss how to overcome the justified grounds for the objection on a timely basis (for example by amendment to the planned publication and/or by protecting Confidential Information before publication) and the objecting Party shall not unreasonably continue the opposition if appropriate measures are taken following the discussion.
Dissemination of Results. The Recipient must disseminate its results as soon as feasible, in a publicly available format, subject to any restrictions due to the protection of intellectual property, security rules or legitimate interests. If Recipient intends to disseminate its results, it must give at least 15 days advance notice to KIC LE and the other Recipients involved in the same Project (unless agreed otherwise), together with sufficient information on the results it will disseminate. The KIC LE or another Recipient involved in the same Project may object within (unless agreed otherwise) 15 days of receiving notification, if it can show that its legitimate interests in relation to the results or background would be significantly harmed. In such cases, the results may not be disseminated unless appropriate steps are taken to safeguard those interests.

In the event such Open Access publication is not reasonably possible with the publisher or journal of first choice, the Recipient must ensure such book or journal article is placed in a suitable Open Access repository, in post-print form, within twelve months of publication. The Centre maintains the IDRC Digital Library (IDL), an open access repository for Grey Literature. The Recipient must submit to the Centre, in accordance with the IDRC Connect User Guide, Grey Literature in electronic form, for publication in the IDL on an Open Access basis. Dissemination of Results. Regular revision of the Plan for Using and Disseminating the Results. The Plan for Using and Disseminating the Result must contain the way the Participants foresee the use of their Result arising from the CRP. A first version of it was included in the full proposal which was submitted by the Participants at the call for offers. In accordance with section 3 of the IPR Conditions, the Participants shall revise every 12 (twelve) months, and at the end of the CRP, the Plan for using and Disseminating the Results. The Collaborative Board will make propositions for the update of the Plan for Using and Disseminating the Result in the progression reports and in the final report as stated under section 4.4.2 and 4.4.3. Time limitation for dissemination of the Results If Dissemination of the Results would not adversely affect its protection or its use, the Participants shall ensure that it is disseminated within a period of two years after the end of the present CRP. Should the Participants fail to do so, the concerned Partners of ERA-CAPS may disseminate the Results. In doing so, the concerned Partners of ERA-CAPS shall take particular account of the following factors: The need to safeguard intellectual property rights; The benefit of swift dissemination, for example in order to avoid duplication of research efforts and to create synergies between projects; Confidentiality; The Legitimate Interests of the Participants, in particular the acknowledgement of authorship.
